Abstract

This study aims to analyze children's rights and parenting patterns in post-divorce in Mungkajang Sub-district, Palopo City. This research was analyzed by descriptive qualitative with a religious approach (fiqh parenting, parenting jurisprudence). Data were collected through documentation and interviews with parents and children. The results showed that: (1) the form of fulfilment of children's rights after divorce in Mungkajang District is divided into: democratic parenting (fulfilment of children's rights from the father), authoritarian parenting (fulfilment of children's rights from the mother) and permissive parenting (fulfilment of children from the father and mother), and children at an individual stage; (2) Factors that influence parenting patterns that come from fathers are parental relationships and parental age with a model of practicing children's worship in the form of the implementation of 5-time prayers and Ramadan fasting that is well implemented, and the implementation of reading the Koran 2 to 3 times a week; Factors influencing parenting patterns originating from mothers are the involvement of parents with a model of practicing children's worship in the form of the implementation of 5-time prayers and fasting Ramadan which is well implemented, and the implementation of reading the Koran is uncertain; and factors influencing parenting patterns originating from both parents are the age of parents and the practice of parenting children with a model of practicing children's worship in the form of 5-time prayers, fasting and reading the Koran has been going well.

Abstract

This study aims to examine the hadiths of the Prophet Muhammad (peace be upon him) relating to child education within the family and to examine their relevance to the concept of Islamic family law. Through a thematic approach to authentic hadiths, this study outlines parents' responsibilities in instilling religious values, morals, and character formation in children from an early age. The results of the study indicate that child education is an integral part of parental obligations recognized in Islamic family law, not only as a moral responsibility but also as a legal obligation. The Prophet's hadiths provide a strong foundation for establishing an educational system within Muslim families, while emphasizing the importance of parents' active and consistent role in fostering their children's spiritual and social development. This study recommends strengthening parents' religious understanding as a basis for fulfilling their obligation to educate children within the context of Islamic family law.

Abstract

Consultation (shura) is a fundamental principle in Islamic teachings that functions not only as political ethics, but also as a collective method for social and family decision-making. Although many studies highlight consultation in the context of state affairs, studies on its implementation in household dynamics are still limited. This study aims to analyze the concept and meaning of musyawarah in Surah Ali Imran (3): 159, Surah al-Syura (42): 38, and Surah al-Baqarah (2): 233 based on the interpretations of classical and contemporary exegetes, as well as analyzing the relevance and implementation of these principles in building harmony in household life. This study uses a thematic interpretation (maudhu'i) method. Data collection was conducted through library research by referring to classical and contemporary interpretation literature. The results of the study show that deliberation in the Qur'an includes the principles of gentleness, equality, mutual agreement, collective participation, and moral responsibility. Surah Ali Imran (3): 159 emphasizes the importance of gentle and communicative leadership; Surah al-Syura (42): 38 places deliberation as a key characteristic of a community of believers, including within the family environment; while Surah al-Baqarah (2):233 emphasizes deliberation as a fundamental principle in family relationships, especially between husband and wife. Abstract

Pernikahan dini masih menjadi fenomena sosial yang cukup tinggi di Sulawesi Selatan, khususnya pada masyarakat Bugis yang memiliki sistem nilai dan adat istiadat yang kuat. Adat Bugis yang menjunjung tinggi konsep siri’ (harga diri), kehormatan keluarga, serta tekanan sosial terhadap hubungan laki-laki dan perempuan sering kali mendorong keluarga untuk menikahkan anak pada usia dini sebagai upaya menjaga martabat dan menghindari aib sosial. Penelitian ini bertujuan untuk menganalisis pengaruh adat Bugis terhadap tingginya angka pernikahan dini di Sulawesi Selatan serta implikasinya terhadap perlindungan hak anak. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan sosiologis dan normatif, melalui studi literatur, peraturan perundang-undangan, serta hasil penelitian terdahulu yang relevan. Hasil penelitian menunjukkan bahwa nilai-nilai adat Bugis berperan signifikan dalam membentuk pola pikir masyarakat yang memandang pernikahan dini sebagai solusi atas persoalan sosial dan moral. Namun, praktik tersebut sering kali bertentangan dengan ketentuan hukum nasional serta berdampak negatif terhadap pendidikan, kesehatan, dan kesejahteraan anak. Oleh karena itu, diperlukan upaya harmonisasi antara nilai adat dan hukum negara melalui pendekatan edukatif dan kultural agar pencegahan pernikahan dini dapat dilakukan secara efektif tanpa menghilangkan identitas budaya masyarakat bugis.
