Abstract

The licensing agreement means an agreement that functions as a group to regulate the legal ties between licensors and licensees. The license agreement must be registered by the minister in the general list of Copyright License agreements. However, what is a problem is whether the license agreement made by a special group is able to bind a third party if the copyright has not been registered based on the arrangement of procedures for recording the license agreement. Based on this, other problems arose in this research, namely (1) How to regulate procedures for registration of broadcasting license agreements, and (2) What are the legal consequences of licensing agreements with third parties. Based on this, there is a vacuum of norms found in Article 83 paragraph (4) of Law Number 28 of 2014 concerning Copyright; based on this matter the author examines this research using normative methods. In writing the author uses the method of legislative approach and legal concept analysis approach. In the source of legal material in this study on primary, secondary and tertiary legal materials. Finally the legal material collection technique uses a card system. Legal material analysis techniques used are descriptive techniques, interpretive techniques, evaluative techniques, systemic techniques and argumentative techniques. In a licensing agreement there is a legal consequence of a licensing agreement with a third party where one of the parties violates or defaults where the licensing agreement is not recorded at the Directorate General of Intellectual Property Rights which only binds the parties to the agreement, namely the licensor and the licensee. A result that can occur from the existence of bad faith, or default by the parties, the agreement can be canceled or null and void by law. The legal settlement efforts in the misappropriation of this licensing agreement can be done by non-Litigation and litigation.

Abstract

To improve the welfare of the community, one of the non-banking institutions is the cooperative providing credit loan facilities for the needs of the community. The aim is as a means of channeling loans or credit for priority communities and people in general. But in reality, the easier the provision of credit services to the public, tends to be a serious problem in the payment of credit. For example, defaults carried out by the community by not implementing the agreed agreement. Therefore the authors are interested in conducting research with the formulation of the problem 1) What are the causes of default by the debtor in the implementation of the loan agreement at Dana Rahayu Cooperative? 2) How do you settle defaults by debtors at the Dana Rahayu Cooperative? The research method used is a empiris research method. The debtor can be said to default if the debtor does not do what he is willing to do, does what he promised is not as promised, does what he promised but is too late, does something that according to the agreement he cannot do. The cause of the default at the Dana Rahayu Cooperative was because the debtor did not pay the arrears for one year and nine months as agreed in the credit agreement. In the Dana Rahayu Cooperative Management Decision, the default made by the debtor on the credit agreement is resolved as far as possible using a family approach to the borrowing member. and it is impossible to do a settlement, the last resort is to carry out the seizure of collateral.

Abstract

Abstrak—Penggunaan perjanjian nominee yang merupakan perwujudan adanya suatu perikatan. Perwujudan nominee ada pada surat perjanjian yang dibuat oleh WNA dan WNI sebagai pemberi kuasa, dalam perjanjian itu bermaksud untuk memberikan kewenangan terhadap WNA selaku penerima kuasa dalm melakukan perbuatan hukum terhadap tanah yang tidak dapat dimilikinya yaitu hak milik. Ada dua masalah dalam penelitian, yaitu: (1) Mekanisme penguasaan hak atas tanah oleh orang asing, (2) Kekuatan hukum penguasaan hak atas tanah berdasarkan perjanjian pinjam Nama (Nominee). Tujuan penelitian untuk memahami mekanisme penguasaan hak atas tanah yang dilakukan oleh orang asing dan untuk mengetahui kekuatan hukum dari penguasaan hak atas tanah oleh orang asing berdasarkan perjanjian pinjam nama (nominee). Metode penelitian menggunakan penelitian hukum normatif dari studi pustaka atau hokum positif yang berlaku. Berdasarkan penelitian diketahui bahwa: (1) Penguasaan hak atas tanah oleh WNA dilakukan dengan hak pakai dan hak sewa, dan adanya suatu perjanjian pinjam nama, nama WNI dicantumkan di sertifikat hak milik. (2) Kekuatan hukum pernjanjian pinjam Nama dilihat dari Pasal 1338 Ayat 1 KUHPerdata, setiap perjanjian dibuat secara sah berlaku sebagai Undang-undang.

Abstract

The development of business in the community requires the entity of a business entity to ensure legal certainty in doing business. One entity that is always in demand by the public is a limited partnership or commanditaire vennootschap (CV). Limited partnership is a business entity that requires a bank financial institution to conduct transactions in the financial sector. In a limited partnership, two actions will be taken, namely the freezing of the limited partnership or the dissolution of the limited partnership if it does not achieve the goals and objectives or does not achieve profits. In the description above, there isalso the formulation of the problem (1) How is the arrangement of limited partnership dissolved in relation to banking activities? (2) What are the legal consequences of the disbanded limited partnership on banking activities in relation to third parties? This research uses normative research methods based on expert opinion, literature and legislation. The author has analyzed a court decision where the limited partnership which has been dissolved but still has problems with the banking sector that must be resolved and the case contains elements of ne bis in idem so that the court's decision does not accept the lawsuit.

Abstract

Less optimal control function has been done by institutions existing oversight led to still many irregularities in the awarding of public service to the community, such fraud commonly called the behavior of maladministration. This is what inspired the creation of the Ombudsman of the Republic of Indonesia. The problem is how the Ombudsman RI authority in exercising oversight over public services organized by the State? and how is the position of Ombudsman RI in RI constitutional arrangement to achieve good governance in Indonesia ? The type of research in this thesis is the type of normative research, to approach the problem approach is the approach of legislation and conceptual approaches. The existence of the Ombudsman of the Republic of Indonesia can be seen from the implementation of the Ombudsman's supervisory function which has a good impact, this can be seen from the creation of good public services in accordance with the law and good governance. contained in the Ombudsman Law of the Republic of Indonesia Number 37 of 2008 Article 6, Article 7, and Article 8 in receiving reports of alleged maladministration.
