Abstract

Tourism has several forms, one of which is community-based tourism. Community-Based Tourism, or what is often referred to as Community Based Tourism (CBT) is a form of tourism managed by local communities with an emphasis on environmental, social, and cultural sustainability principles to help tourists understand and learn the local community's way of life. CBT aims to build and strengthen organizational capabilities in local communities. CBT prioritizes improving the welfare of the community through the empowerment of tourism village development which is carried out based on the potential of the rural community itself. Likewise, Apuan Village, Susut District, Bangli Regency, which is rich in potential spiritual tourism objects such as the Tirta Payuk tourist attraction in the Banjar Bangunlemah Kangin, Yeh mangsi, and Tirta Empul attractions in the Banjar Apuan. However, the problem then is that the utilization of tourism objects in Apuan Village has not been maximized. In this study, the object of study to be studied is Apuan Village by emphasizing the model of tourism object development by analyzing the potential and characteristics of Apuan Village so that later an appropriate tourism object development model can be arranged so that it can be applied optimally.

Abstract

The responsibility of the State in ensuring the fulfillment of the people's right to drinking water is carried out through the implementation of the Drinking Water Supply System (SPAM), one of which can be implemented by BUM Desa. The problems to be studied are: What is the legal form of BUM Desa in drinking water management in Apuan Village? and what efforts are made by the BUMDes of Apuan Village in optimizing drinking water management? This research is empirical legal research with a sociology of law approach. The results of the study indicate that the legal form of the Apuan Village BUM must be renewed through a conversion process so that it is a legal entity and reorganizes the drinking water management business unit so that it has legality in drinking water management. In the context of optimizing drinking water management, a legal instrument is needed in the form of the Apuan Village Regulation on the Drinking Water Management System based on the SDA Law and the SPAM PP to ensure certainty of the quality, quantity, and continuity of SPAM for the Apuan Village community. Furthermore, it is necessary to prepare SPM and SOP, monitoring facilities, as well as human resource development for drinking water management through comparative studies and training or mentoring.

Abstract

Gelgel Village is one of the villages in Bali known for producing Balinese woven fabrics, namely songket and endek fabrics. Songket/endek fabric is one of the characteristics of Balinese cultural products. In order to preserve songket weaving, legal protection is necessary. Moving on from this matter, there are several problems experienced by participants in this program, namely: 1) Lack of interest of the younger generation in working as weavers, 2) Lack of compatibility of work results required by employers with weavers, and 3) Legal protection for workers and employers of songket/short cloth weaving in Gelgel Village, Klungkung. The activities carried out in this program were to provide counseling on the importance of preserving songket weaving as a cultural characteristic. These activities increased the younger generation's interest in weavers by counseling them on preserving songket weaving as a cultural characteristic. In addition, a good working relationship is needed in the songket/short woven fabric production process so that the weaving results are by the expectations of employers and consumers. Legal protection for weaving workers is to provide their rights as workers by applicable laws and regulations. Entrepreneurs are also encouraged to get legal protection by making Intellectual Property Rights (IPR) in the form of Copyright.

Abstract

Apuan Village is one of the villages located in Susut District, Bangli Regency. The Apuan Village Government has received assistance from the Bangli Regency Government in the context of the construction of drinking water supply facilities which in its management are handed over to Apuan Village. In its development, the distribution of drinking water in Apuan Village has not been able to reach the entire community of Apuan Village, so a drinking water facility development program is needed. However, the program is constrained in terms of authority and funding. In fact, the results of the management of water sources for drinking water which are handled by Apuan Village, are fully intended for the benefit of the village community, so there is no availability of funds to support the program plan for the development of drinking water management facilities. The Apuan Village Government does not have the authority to carry out the water management development program, considering that there is no legal umbrella for the Apuan Village Government to run the drinking water management development program in Apuan Village. The solution to overcome partner problems is to provide legal assistance and counseling related to the legal form of the drinking water management development program and the realization of a harmonious working relationship in the development of drinking water management in Apuan Village.

Abstract

Demonstrasi sebagai implementasi kebebasan menyampaikan pendapat ialah hak konstitusional yang dijamin didalam UUD Negara Republik Indonesia Tahun 1945 dan tertuang lebih lanjut dalam insrumen hukum nasional lainnya, seperti Undang-Undang Nomor 9 Tahun 1998 tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum dan Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Namun, pelaksanaan aksi demonstrasi sering kali dihadapkan pada tindakan represif aparat kepolisian yang tidak proporsional sehingga menimbulkan dugaan pelanggaran HAM. Penelitian ini bertujuan untuk mengetahui pengaturan hukum mengenai tindakan represif aparat kepolisian dalam pengamanan aksi demonstrasi serta menganalisis bentuk pelanggaran hak asasi manusia yang dapat timbul dari tindakan tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual melalui studi terhadap berbagai bahan hukum primer, sekunder, dan tersier. Hasil penelitian membuktikan bahwa secara normatif dalam pengamanan, kepolisian wajib mengedepankan prinsip legalitas, kebutuhan, dan proporsionalitas, serta menempatkan tindakan represif sebagai upaya terakhir. Namun, tindakan represif yang dilaksanakan secara berlebihan dan tidak proporsional berpotensi melanggar HAM, sebagaimana dijamin dalam UU No. 39 Tahun 1999 mengenai Hak Asasi Manusia dan instrument hukum lainnya. Terdapat konflik norma antara jaminan kebebasan berpendapat dan kewenangan penggunaan kekuatan oleh aparat, yang menjadikan ketidakpastian hukum dan membuka peluang penyalahgunaan kewenangan. Oleh karena itu, diperlukan harmonisasi peraturan serta penerapan pendekatan yang lebih humanis dan berbasis hak asasi manusia dalam penanganan aksi demonstrasi.

Abstract

Penelitian ini bertujuan untuk mengetahui prosedur dan faktor-faktor penghambat pemenuhan Hak Restitusi terhadap anak sebagai korban kekerasan seksual. Adapun penelitian ini merupakan penelitian empiris dengan pendekatan yuridis empiris yang hasil akhirnya dianalisis secara kualitatif. Hasil dari penelitian ini dapat disimpulkan prosedur pemenuhan Hak Restitusi dapat diajukan oleh pihak korban, didampingi oleh LPSK dan Lembaga Perlindungan Anak. Restitusi dapat diajukan baik sebelum maupun setelah adanya putusan incracht. Terkait mekanisme penghitungan besaran Restitusi masih belum terdapat standarisasi, namun pihak LPSK dapat melakukan asesmen kalkulasi permohonan dengan batas nilai kewajaran dan proyeksi pemulihan psikologis sebagai acuan. Faktor penghambat internal mencakup belum adanya standarisasi penghitungan Restitusi, realisasi perlelangan aset yang terhambat, kurangnya daya paksa hukum dan tidak terlaksananya Dana Bantuan Korban. Faktor penghambat eksternal mencakup minimnya informasi mengenai Restitusi, kendala administrasi, itikad baik dan kondisi ekonomi pelaku serta terbatasnya fasilitas pemulihan psikologis.

Abstract

Keadaan lingkungan di Kabupaten Klungkung telah menunjukkan beberapa tanda peningkatan kerusakan dan pencemaran lingkungan. Dalam rangka perlindungan lingkungan hidup Pemerintah Kabupaten Klungkung mengeluarkan Perda Nomor 2 Tahun 2010 tentang Pengendalian Kerusakan Dan Pencemaran Lingkungan Hidup. Berdasarkan uraian tersebut tujuan penelitian ini adalah untuk membahas efektifitas Perda Nomor 2 Tahun 2010 dan mengkaji kendala-kendala dalam penegakan Perda Nomor 2 Tahun 2010. Tipe Penelitian yang digunakan adalah penelitian hukum empiris, dimana data yang digunakan dalam penelitian ini adalah data primer dan data sekunder. Teknik pengumpulan data wawancara lapangan, dan observasi di lapangan. Hasil penelitian ini menemukan bahwa efektifitas Perda dalam upaya menghentikan tingkat pencemaran di pantai Watu Klotok dengan upaya preventif dan upaya represif melalui: sanksi administratif berupa teguran lisan, teguran tertulis, sanksi pidana denda atau perdata atas kerusakan atau pencemaran lingkungan. Adapun kendala yang ditemui diantaranya: faktor dari implementasi aturan hukumnya sendiri, faktor dari aparat penegak hukum, kebudayaan masyarakat, ekonomi serta kesadaran masyarakat. Kesimpulan dari hasil penelitian menunjukkan bahwa, efektifitas Perda tersebut belum diterapkan secara efektif oleh para penegak hukumnya dalam hal pemberian sanksi. Oleh karena itu Pemerintah Kabupaten Klungkung harus lebih tegas dan bijaksana dalam menerapkan Peraturan Hukum yang ada.

Abstract

Formerly the Indonesia forest rich in diversity and different kinds of populations in them but this time the forests of Indonesia into the world's endangered forests because of the result of the destruction of forests by cutting down trees in the wild. Wild forest logging becomes one of the factors of damage in forest area is currently logging the forest resulting in negative impact be bald. Although there are already rules governing logging prohibitions are still many wild is also the person who is doing the logging of trees in the forest are wild. The problem of this research is to 1) How is regulate about the prohibition on logging in wild? 2) How is the application of the sanctions for the perpetrators of the deforestation in the wild? Research methods used are normative, legal research methods with the study of the library of primary and secondary legal materials. Research results can be concluded that: 1) the prohibitions of wild forest logging is regulated in the law of forestry Number 41 Year 1999, Act No. 18 years 2013 on prevention and eradication of Forest Destruction and regulations Government forest protection Number 28-year 1985. 2) Penalties for perpetrators who commit illegal logging may include civil penalties, administrative sanctions and criminal sanctions. Of that society expected to care about the environment, because one of the causes of the occurrence of natural disasters, namely wild deforestation.

Abstract

Of natural resources is the primary object for any development Countries Indonesia, thus unwittingly slowly at least not among them triggering pollution and/or destruction of the environment. Therefore, the need for law enforcement that is reflected in the legislation. The problem of this research were: 1 a complaints handling procedure) how pollution and/or destruction of the environment? 2) How the application of sanctions to force the Government in pt. Mirtasari Hotel Development? The type of research and the approach used is the juridical problems of empirical and juridical sociological. Source material source materials used law of law of primary and secondary sources of law. Legal materials collection techniques are used namely study library and field. As well as legal materials collected processed and analyzed with the use of legal argumentation. As for the results of this research are the complaints handling procedures due to contamination and/or destruction of the environment will be followed up by agencies or institutions or the PPLHD PPLH advance has received complaints directly or not direct, which is then followed up with several stages, namely: the stages of the preparation, the implementation of field verification, data analysis, and final verification report the complaint. The application of administrative sanctions the Government at PT. Mirtasari Hotel Development was given by the Minister of the environment in the form of the action force to immediately complete the related permit temporary storage of waste, waste water disposal B3, B3 waste submission to third parties, as well as complement the facilities by the rules in the temporary storage of waste B3.

Abstract

The growth in the tourism sector in Bali has certainly delivered positive adavantages to particularly the enhancement of community prosperity. In encouraging the prevalence of opportinity take to make efforts to enhance the community welfare and empowerment, tourism villages can be one of the useful facilities to help increase the community economy. The proposition explored in this study is that in Tabanan there are still tourism villages which could not develop optimally. Therefore, this study is designed to examine the factors that hinder the optimal development of the village in question. Moving on from the obstacles that have been found, a solution is raised to help overcome the delay in development. The solution is to introduce and implement a model for developing tourism villages in Tabanan. This study makes use of empirical legal research with two types of data: primary and secondary data. The study sample is determined by applying a non-probability/non-random sampling technique. The model of tourism village development in Tabanan is based on empowerment of local communities (community-based tourism). This model of tourism village development is inseparable from religious values, the living culure in the community, and the preservation and quality of the environment. By the application of this model, sustainable tourism development is expected to be realized.
