Abstract

Penelitian ini bertujuan untuk menganalisis dampak ketiadaan pengaturan tersebut terhadap penyelesaian sengketa di KJPP dan mengevaluasi efektivitas mekanisme penyelesaian sengketa yang tersedia. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa tidak adanya ketentuan batas usia pensiun membuka peluang penyalahgunaan kewenangan oleh pihak ketiga melalui pemberian kuasa umum, menghambat pengambilan keputusan, dan memicu konflik internal antar rekan. Penyelesaian melalui litigasi dinilai memakan waktu dan biaya, sedangkan non-litigasi melalui MAPPI dan PPPK bersifat tidak mengikat. Penelitian ini merekomendasikan penetapan batas usia pensiun Penilai Publik, pengaturan mekanisme voting, pembatasan kuasa umum, serta penguatan kewenangan MAPPI dan PPPK. Implikasi temuan ini diharapkan dapat memberikan kepastian hukum dan mendukung tata kelola profesi yang profesional dan akuntabel. This study aims to analyze the impact of the absence of such arrangements on dispute resolution in the KJPP and evaluate the effectiveness of the available dispute resolution mechanisms. This research uses normative legal methods with legislative, conceptual, and case approaches. The results of the study show that the absence of a provision on the retirement age limit opens up opportunities for abuse of authority by third parties through the granting of general power, hindering decision-making, and triggering internal conflicts between colleagues. Settlement through litigation is considered time-consuming and cost-consuming, while non-litigation through MAPPI and PPPK is non-binding. This study recommends the determination of the retirement age limit for Public Appraisers, the regulation of voting mechanisms, restrictions on general power, and the strengthening of the authority of MAPPI and PPPK. The implications of these findings are expected to provide legal certainty and support professional and accountable professional governance.

Abstract

Tujuan penelitian ini adalah untuk meneliti dampak hukum pelanggaran kode etik notaris dalam pembuatan akta di luar wilayah jabatannya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi literatur melalui analisis Undang-Undang Jabatan Notaris (UUJN), kode etik profesi, putusan hukum, serta artikel ilmiah terkait. Hasil penelitian menunjukkan bahwa notaris yang melanggar batas wilayah jabatan dapat dikenai sanksi administratif, etik, hingga perdata, dan dalam kondisi tertentu pertanggungjawaban pidana bila terdapat unsur kesengajaan atau kerugian. Dari sisi produk hukum, akta yang dibuat di luar yurisdiksi notaris kehilangan keotentikannya dan hanya berkedudukan sebagai akta di bawah tangan sehingga kekuatan pembuktiannya berkurang dan dapat dibatalkan secara hukum. Penelitian ini menegaskan pentingnya penegakan kode etik, penguatan pengawasan oleh INI dan IPPAT, serta kejelasan sanksi dalam regulasi agar prinsip kepastian hukum dan perlindungan terhadap para pihak dapat terjamin. The purpose of this study is to examine the legal implications of violations of the notarial code of ethics in drafting deeds outside the notary’s territorial authority. The research method employed is normative juridical, using a literature study approach through an analysis of the Notary Office Act (UUJN), professional codes of ethics, court decisions, and relevant scholarly articles. The findings indicate that notaries who breach territorial boundaries of their office may be subject to administrative, ethical, and even civil sanctions, and under certain conditions, criminal liability if elements of intent or harm are present. In terms of legal products, deeds executed outside a notary’s jurisdiction lose their authenticity and are deemed equivalent to private documents, thereby reducing their evidentiary strength and making them legally subject to annulment. This study underscores the importance of enforcing the code of ethics, strengthening oversight by INI and IPPAT, and ensuring clarity of sanctions in regulations to guarantee legal certainty and protection for all parties involved

Abstract

This study analyzes the complexities of contractual disputes and termination mechanisms in Indonesia’s construction and public procurement sectors. It identifies unilateral termination and payment delays by government entities as often unlawful acts that leave contractors in a vulnerable bargaining position. The research contrasts litigation options in district and administrative courts with alternative dispute resolution (ADR) methods such as mediation and arbitration, highlighting the varying pathways for enforcement and relief. Study adopts a normative juridical approach, relying on statutory texts, case law, doctrinal discussions, and academic literature. It emphasizes comparative insights where relevant to Indonesian practice and integrates doctrinal analysis with practical considerations from project governance and procurement processes. This `article offers a balanced contractual protection model consisting of three main components: standardization of national construction contract clauses, which regulate the obligation to provide compensation and clarification mechanisms before contract termination is carried out; establishment of a construction contract mediation institution, which is independent, fast, and affordable in terms of cost, to be an effective alternative before resorting to arbitration; and reform of national contractual law, through the adoption of the principles of good faith and equitable remedies. This model is expected to be able to close the gap between law in books and law in action, and ensure that every construction contract is implemented with the principles of fairness, transparency, and shared responsibility.
