Abstract

Digital transformation has emerged as a strategic response to longstanding problems in Indonesia’s correctional system, including overcrowding, high recidivism, and limited resources. Beyond administrative modernization, digitalization is increasingly viewed as a pathway toward a more humane and rehabilitative penal paradigm. This article examines how digital transformation contributes to rehabilitation and social reintegration of inmates in Indonesia. Using a qualitative juridical-empirical method, the study combines normative analysis of laws and human rights principles with empirical data drawn from policy reports, academic studies, and correctional practices. The findings highlight three key contributions of digitalization. First, rehabilitation efforts are strengthened through online learning platforms, digital vocational training, and virtual counseling programs that expand access to inmate development. Second, transparency and accountability are enhanced by integrated databases and complaint systems that reduce maladministration and increase public trust. Third, reintegration opportunities improve through digital entrepreneurship initiatives and technology-based connections with the labor market. These results suggest that digital transformation can be a vital instrument for realizing the rehabilitative mandate of Law Number 22 of 2022 and advancing restorative justice. Properly integrated into correctional policy, digitalization not only increases efficiency but also promotes a correctional system that is more just, inclusive, and socially sustainable.

Abstract

The presence of a child born outside of marriage raises various issues both within families and society, particularly regarding the rights and obligations of the child. A child born out of wedlock may not solely result from an illicit relationship; it can also occur when a marriage is conducted only according to customary law without being officially registered. According to Article 80 of the Civil Code, prior to the Marriage Law, marriage must be performed in front of a Civil Registry official. Article 81 stipulates that religious ceremonies must occur after the civil registration. This research aims to analyze the implementation of birth registration regulations for children born out of wedlock based on Islamic justice, identify weaknesses in issuing birth certificates without a marriage certificate, and reconstruct these regulations in alignment with Islamic values. The research employs a constructivist paradigm, using a sociological-legal approach and various data collection methods. Findings indicate that the implementation of birth registration for children born out of wedlock lacks fairness, necessitating protection to ensure equal treatment with other children. Current regulations are insufficiently clear regarding children born out of wedlock, highlighting a need for better synergy among law enforcement. The reconstruction of these regulations is outlined in Law No. 23 of 2006 and the more recent Law No. 24 of 2013 regarding population administration.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar pertanggungjawaban pidana terhadap pelaku pencabulan mayat oleh pengidap nekrofilia serta menilai relevansi kemampuan bertanggung jawab pelaku dalam konteks hukum pidana nasional. Pertanyaan utama yang ingin dijawab adalah bagaimana konstruksi pertanggungjawaban pidana terhadap pelaku nekrofilia dan norma hukum apa yang dapat dijadikan dasar pemidanaan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang- undangan, konseptual, dan kasus, melalui studi kepustakaan terhadap peraturan perundang- undangan, doktrin hukum pidana, serta literatur psikologi forensik. Hasil penelitian menunjukkan bahwa perbuatan pencabulan terhadap mayat dapat dikualifikasikan sebagai tindak pidana melalui penafsiran sistematis Pasal 271 Undang-Undang Nomor 1 Tahun 2023 tentang KUHP, namun pemidanaan bergantung pada kemampuan bertanggung jawab pelaku. Penelitian ini berkontribusi pada penguatan integrasi antara hukum pidana dan psikologi forensik dalam menangani kejahatan seksual non-konvensional. Kesimpulannya, diperlukan pengaturan pidana yang lebih eksplisit serta standar pemeriksaan kejiwaan yang komprehensif guna menjamin kepastian hukum dan keadilan substantif, sekaligus membuka ruang bagi penelitian lanjutan berbasis komparatif dan kebijakan kriminal.
