Abstract

Although customary land rights are still recognized by the Basic Agrarian Law, in practice many land offices process such land through granting rights over state land, as occurred in Pargarutan Jae, Sialagundi, and Muara Tais Villages where this normative juridical research using descriptive qualitative methods shows that unregistered community land is categorized as state land by the South Tapanuli Regency Land Office, resulting in land rights transfer being conducted through the PHGR mechanism despite the fact that it should be processed through sale and purchase deeds and rights conversion in accordance with applicable legal provisions. The Land Office plays a role in conducting land registration through the PTSL program and socialization to provide legal certainty, but still faces obstacles of low public understanding about procedures and benefits of land certificates, thus requiring harmonization between statutory provisions and field practices so that customary land rights status remains recognized and can be registered through rights conversion mechanisms, as well as strengthening collaboration with village officials and expanding socialization to eliminate negative public perceptions regarding land registration.

Abstract

The marriage ceremony of the Karo tribe is a sacred ritual that must be performed before couples can participate in other traditional ceremonies, with an exogamy system that requires marriage outside the clan (berimpal marriage) but creates complexity in terms of inheritance distribution and property arrangements. This empirical juridical research in Padang Mas Village, Kabanjahe District, Karo Regency analyzes the inheritance distribution mechanism in berimpal marriages and legal protection for heirs through literature study and interviews with descriptive analysis. The research findings show that the Karo inheritance system is patriarchal in nature, granting exclusive rights to male children according to traditional customs, however its legal protection depends on local government recognition and the Karo customary system does not have positive legal force as evidenced by the Supreme Court decision that recognizes the inheritance rights of female children, while inheritance dispute resolution can be conducted through two approaches namely civil law that guarantees legal certainty and kinship system that prioritizes social harmony and maintenance of kinship relationships.

Abstract

Certificates serve as valid proof of ownership under Indonesian law with the primary objective of providing legal certainty’. However, why is it that a land certificate must sometimes be annulled? Such situations may lead to ambiguity in legal implementation and result in a lack of legal certainty and protection for certificate holders. This study raises several legal issues: How is the application of the negative publication system with a positive tendency in land registration able to ensure legal certainty over the status of land certificates issued by the Land Office? How should the legal reasoning of judges in annulling Certificate of Ownership No. 212/Pasar Pangururan through Decision No. 35/G/2020/PTUNMDN be analyzed in relation to the value of justice? What are the legal responsibilities of the Head of the Land Office of Samosir Regency in issuing Certificate of Ownership No. 212/Pasar Pangururan to the aggrieved party?. This study is a normative juridical research employing a descriptive analytical approach. he findings indicate that the implementation of the negative publication system with a positive tendency in land registration has not yet maximally provided legal certainty regarding the status of ownership certificates issued by the Land Office, as such certificates can still be subject to legal challenge

Abstract

The Notary Protocol, as a state archive, must be safeguarded, preserved, and maintained. The Minuta Akta, as an integral part of the Notary Protocol, carries a crucial function as the basis for issuing copies of deeds; therefore, its existence must be guaranteed. This study analyzes the following issues: the mechanism for submitting and receiving the Notary Protocol when a notary relocates, including the legal responsibility for Minuta Akta that are not submitted; the forms of legal sanctions imposed on notaries who fail to submit the protocol completely after relocation; and the available legal remedies for parties requiring a Minuta Akta that forms part of the Notary Protocol. This research employs a normative juridical method. The results of the study show that the mechanism for submitting the Notary Protocol is regulated under Article 63 of the Notary Office Law (UUJN-P) and Minister of Law and Human Rights Regulation No. 22 of 2025. The submission of the Notary Protocol is formalized through the signing of a Handover Report (Berita Acara Serah Terima) witnessed by the Regional Supervisory’ Council (MPD).

Abstract

High ancestral property (harta pusaka tinggi) in Minangkabau is a communal right inherited matrilineally and, in principle, may not be transferred individually, which makes it highly vulnerable when land registration is conducted in a distorted manner. The research method employed is normative juridical research. The results show, that unlawful acts in the registration of high ancestral property are reflected in land registration carried out by parties not authorized as mamak kepala waris, the falsification or manipulation of genealogical records (ranji) and customary documents, and the disregard of the principle of “bulek kato dek mufakaik” (decision by consensus) in decision-making over clan land. legal protection of high ancestral property operates on multiple layers through customary mechanisms and national legal instruments, including the recognition of communal rights in the 1945 Constitution and the Basic Agrarian Law, land registration regulations, and civil lawsuits against defective land certificates.

Abstract

The issuance of Freehold Title Certificates (Sertipikat Hak Milik/SHM) for land is intended to provide legal certainty; however, in practice, ownership disputes frequently occur. The issue becomes crucial when involving the conversion of customary land titles (hak milik adat), which in practice has not fully guaranteed legal certainty regarding the history of ownership. This problematic is reflected in Supreme Court Decision No. 1012 K/Pdt/2023. The Supreme Court dismissed the cassation appeal from the heirs (certificate holders) on the grounds that they failed to prove a legal relationship with the original owner, whereas PT. MKP was able to provide evidence of a deed of relinquishment of rights and 20 years of physical possession. The results show, This decision erroneously re-imposes the burden of proving inheritance status on the SHM holder, undermines the negative publication system with a positive tendency, and fails to provide legal protection to the bona fide certificate holder.
