Abstract

Indigenous land disputes in Indonesia reflect the complexity of the relationship between national and customary legal systems that have not been fully integrated in resolving ownership conflicts. This research employs a normative juridical method to analyze the characteristics of customary land law, legal protection, and unlawful acts in indigenous land disputes in Huta Lumban Gambiri. The research findings indicate that Batak Toba customary land law is communal-spiritual in nature with ownership based on patrilineal lineage through customary symbols such as the Hariara tree, yet faces challenges from legal system dualism. Supreme Court Decision No. 435 K/Pdt/2021 acknowledges the legitimacy of customary rights and historical evidence from Register De Kampoengs, but rejects compensation for the destruction of the Hariara tree, reflecting a lack of understanding of the concept of immaterial loss in customary law.

Abstract

Child adoption serves as an alternative for couples who have not been blessed with children; however, it raises legal issues, paticularly regarding the inheritance rights of adopted children. Under civil law, adopted children are entiled to inheritance rights equivalent to those of biological children,in contrast, islamic law does not grant adopted children direct inheritance rights;instead, they may recive inheritance through a wasiat wajibah (mandatory will). This disrepancy creates legal uncertaintly in juridical practice, as reflected in the palangkaraya Distric Court Decision No. 27/Pdt.G/2019/PN.PLK. This study employs a normative legal research method with descriptive analytical approach and Comparative legal. The findings reveal that although adopted children do not have automatic inheritance rights under either legal system, islamic law provides protection through the wasiat wajibah mechanism (up to one-third of the estate), while civil law relies on will and grants.

Abstract

The negative tendency positive land registration publication system in Indonesia, although designed to provide legal certainty, can in practice be misused by irresponsible individuals for personal gain while ignoring the rights of legitimate heirs. This creates legal uncertainty and harms parties who should be protected by the land registration system. The method used in this research is normative juridical research method, which refers to legal norms. The legal implications of issuing property certificates without heir consent in the negative tendency positive land registration system can lead to prolonged legal disputes, uncertainty in land ownership status, financial losses for heirs whose rights are violated, and can harm third parties acting in good faith, as occurred in the Supreme Court Decision No. 1404 K/Pdt/2019 case which created legal uncertainty and cascading losses for various parties.

Abstract

Legal protection for landowners holding land title certificates is a fundamental aspect of Indonesia's land system, which is normatively guaranteed through Law concerning Basic Regulations and Government Regulation, The research method employed is normative juridical approach conducted through literature study to obtain secondary data. certificates function as strong evidence. However, in practice, legal uncertainty still exists due to various factors such as land disputes, overlapping certificates, and weak supervision systems in the land registration process. Analysis of Supreme Court Decision Number 309 PK/Pdt/2021 shows that the Panel of Judges reinforces legal protection for certificate holders who registered legitimately and in good faith by applying the principle of registration time priority, where the party who registers first has stronger rights. This decision also affirms the rejection of overlapping certificates containing legal defects to strengthen legal certainty in the land system.

Abstract

Land ownership disputes between local governments and heirs become increasingly complex when involving land that originally came from a loan arrangement. The case of Lapangan Akso Dano in Supreme Court Decision No. 3580 K/Pdt/2023. The research problems include: first, the legal certainty of land possession status by the local government; second, the legal Construction for protecting regional assets originating from loaned land that has been physically possessed for an extended period; and third, the legal analysis of the judges’ considerations in Supreme Court Decision No. 3580 K/Pdt/2023 regarding land ownership disputes involving loaned land to the local government. This research employs a normative juridical method. The study reveals that legal certainty over land possession by local government is comprehensively regulated through a legal hierarchy from the 1945 Constitution to Government Regulation No. 24/1997, reinforced by customary law recognition of long-term physical possession.

Abstract

Constitutional Court Decision Number 46/PUU-VIII/2010 brought significant changes to the legal status of children born out of wedlock in Indonesia. This ruling reinterprets Article 43 paragraph (1) of Law Number 1 of 1974 concerning Marriage by emphasising that children born out of wedlock not only have civil relations with their mother and maternal family, but also with their biological father as long as this can be proven based on science and/or other evidence according to the law. Consequently, children born out of wedlock have the potential to obtain civil rights, including inheritance rights, from their biological fathers. However, from an Islamic law perspective, the position of children born out of wedlock is different. This study uses a normative juridical method. The conclusion is that there is a normative tension between positive law and Islamic law regarding the inheritance rights of children born out of wedlock. Therefore, legal harmonisation is needed so that the Constitutional Court's decision can be implemented without negating the basic principles of Islamic law, while still guaranteeing the protection of children's rights in accordance with the mandate of the constitution and the principle of justice.
