Abstract

The main issue of this research is the controversy over Article 162 of Law No. 3 of 2020 on Mineral and Coal Mining, which potentially criminalizes anti-mining communities and contradicts social justice values. The research questions are: (1) what are the problems in mining management under Article 162, and (2) how does Siyasah Dusturiyah view mining management by business actors according to this article. This study uses a normative juridical method with conceptual and statutory approaches. The findings reveal: (1) Article 162 contains vague terms such as “obstructing” and “disturbing,” causing legal uncertainty and violating community rights; (2) from the Siyasah Dusturiyah perspective, it fails to uphold justice (al-‘adl), accountability (al-mas’uliyyah), and public welfare (maslahah ‘ammah); and (3) it contradicts maqashid al-syari‘ah by favoring corporate interests over social and environmental protection.

Abstract

. This study will analyze the methodology used by classical Islamic scholars in determining the concept and principles of maqāṣid alshariah. This analysis will compare the method of determining Maqasid Shariah by Muslim scholars with current scientific research methods. This research uses qualitative methodology by reviewing classical and modern scientific writings. The collected data is analyzed thematically based on inductive approach. The results of this study show that the formulation of the concept and principles of Maqasid Sharia involves the analysis of textual commands. The inductive reasoning of istiqrā' applied by Muslim scholars has similarities with thematic analysis in modern qualitative research. The results suggest basing ijtihad and fatwa on maqāṣid al-shariah through holistic textual analysis. This makes it possible to respond to new challenges through appropriate sharia laws by avoiding rigid legalism or unbridled rationalism.

Abstract

Family mediation constitutes an alternative instrument for resolving domestic conflicts that emphasizes a dialogical and reconciliatory approach rather than rigid litigation procedures. This study aims to analyze the position of family mediation from both normative and psychological perspectives by examining the relevant legal regulations and their implications for the mental well-being of the parties involved. Normatively, the research is grounded in Law Number 1 of 1974 as amended by Law Number 16 of 2019 on Marriage, Law Number 23 of 2004 on the Elimination of Domestic Violence, and Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures. From a psychological standpoint, mediation is viewed as capable of reducing tension, enhancing communication, and maintaining the continuity of family relationships. The findings indicate that family mediation has the potential to serve as a humane dispute resolution mechanism; however, its effectiveness remains constrained by limited legal awareness, a lack of professional mediators, and insufficient psychological protection for vulnerable parties. Strengthening regulatory frameworks and integrating psychosocial support are therefore necessary to ensure that family mediation functions as an adaptive and equitable legal instrument.
