Abstract

This article discusses three type ratio estimators for population mean using coefficient of variation and coefficient of kurtosis on double sampling which is a review from the article of Singh et. al [Italian Journal of Pure and Applied Mathematics-N. 28(2011): 135-142]. The three estimators are biased estimators, then the mean square error of each estimator is determined. Estimator with the smallest mean square error is the most efficient estimator. Example is given at the end of discussion.

Abstract

Regional Regulation as implementing regulations that specifically regulates Traffic and Road Transportations in Pekanbaru is Regional Regulation Number 2 year of 2009 about Traffic and Transportations in Pekanbaru. Everyone who wants to open parking area outside the road parking facilities are required to have permission from the local government which is stated in Article 259 paragraph (1) Regional Regulation No. 2 year of 2009 about Traffic and Road Transportations in Pekanbaru. However, not everyone who is opening parking area facilities have the permission of the Local Government Pekanbaru.Based on the result of the research, there are three formulation of the problems. First, the implementation of the provisions of criminal or criminal prosecution against theoffenders of illegal parking management in junior high schools area has basically done, forms of crime has been given by the Department of Transportation, Communication, and informationsof Pekanbaru are not in accordance with what has been stated in Regional Regulation Pekanbaru No. 2 year of 2009 on Traffic and Road Transportations in Pekanbaru which are imprisonment and fine. However, only punishment of fines and penalties that are not in accordance with the Regional Regulations. Second, obstacles of the implementation of the penal provisions against the offenders of illegal parking management in junior high schools area in Warpoyan Damai district in terms of personnel, in terms of casualties, and the terms of their perpetrators.Third, the efforts are being made to overcome the barriers to the implementation of the penal provisions against theoffenders of illegal parking management in junior high schools area in the District of Marpoyan Damai is in terms of personnel, in terms of casualties, and the terms of their perpetrators.

Abstract

Contractor Traffic and road transport have a strategic role in supporting nationaldevelopment and integration as part of efforts to promote public welfare as mandated by the 1945Constitution of the State of the Re public of Indonesia. Road transport is organized in order torealize the traffic and road transport safely, safe, fast, smooth, orderly, and regularly comfortableand efficient, able to integrate other means of transportation, reach all corners of the land area, tosupport equity, driving and supporting national development at a cost affordable to the purchasingpower.Judging from the development of human life, the occurrence of the law starting from thehuman person who is given by God the mind and behaviors that are continuously carried out byindividuals lead to personal habits, if personal habits are imitated by others, then he will alsobecome the habit of that person. Then if all members of the community practice this then graduallythe habit becomes the custom of the community, so adat is the custom of the community, andcommunity groups gradually make the adat as custom which should apply to all members of thecommunity with sanctions, so become customary law. Customary law is what is accepted and mustbe carried out in the community concerned. In order to maintain the implementation of customarylaw so that there are no irregularities or violations, then among the members of the communitythere is a duty to watch over. Thus, gradually these officers became customary heads.One of the areas in Riau Province that still adheres to customary law is the Pujud area ofRokan Hilir Regency, previously Pujud is a village that has the nickname Kampung Melayu Pujud.In 2011 there has been a criminal act involving traffic accidents causing deaths occurring withinindigenous communities in Kecamatan Pujud that can be resolved through customary law throughconsensus negotiations of indigenous peoples, and customary elements and both parties concernedwith criminal acts the. Traffic Accidents are unexpected and accidental incidental streets involvingvehicles with or without other road users resulting in human casualties and / or human losses.In this case there are differences between national law and customary law, this case thefamilies of the suspect and the victim reported to the local Ninik Mamak so that this serious mistakewas quickly resolved and did not become a grudge between the two parties concerned and broughtto the ground of positive law. The culprit is Mr. Ucok and the victim who died was Tina, the causeof which was the negligence of the victim himself, if the victim rode a motorcycle by speeding andpassing his motorcycle to nudge the car until he had an accident and the victim died.Keywords: criminal – Traffic Accident – Dead

Abstract

The board of directors shall be the organ of the company which is fully responsible for the management of the company for the purpose and represents the company either inside or outside the court in accordance with the basic provisions. The management of a limited liability company shall be carried out by every member of the board of directors in good faith and with full responsibility. In order to create a good thing then the board of directors must have what is called the fiduciary duty which is duty of care, it is an obligation for the directors to carry out their responsibilities carefully as a driver in the company, as the life in the company to can run the company continuously. Any member of the board of directors who is considered guilty of negligent in his/her duty shall be held personally liable on the basis of having no good faith and/or no sense of responsibility in performing duties for the interest and business of the company.The purpose of writing this thesis that is, First, to know arrangement about principle of duty of care in Indonesia. Second, to know benchmark of a directors can be assumed not to implement duty of care principle.This type of research is normative legal research or can be called also research doctrinal law. From the results of research problems, there are two main points that are concluded, first, the regulation of the principle of duty of care in Indonesia. Abstract

Corporate crime or White collar crime especially in environmental crime has its ownconstraints. Determining which board is responsible is quite difficult considering the complex formof management in a corporation. Therefore, there are doubts about the possibility of thecorporation to be liable for criminal responsibility and convicted. There are a number of views onthe criminal construction of a corporation so that it has implications for the difficulty ofdetermining corporate wrongdoing for criminal liability. The desire to ensnare corporationsinvolved in environmental crime cases is indeed not easy to realize. Although there is awarenessabout the importance of protecting the environment among law enforcement officials, the fact isthat it is not easy to ensnare perpetrators. Moreover, the majority of environmental criminaldefendants who were brought to court were either free or only sentenced to probation because ofthe difficulty of proving a mistake by a corporation.This research which is entitled "Criminal Accountability Against Corporations ThatConduct Environmental Crimes" aims to find out the effect of errors in determining criminalliability in environmental crime and describe the ideal model of corporate criminal responsibilityfor environmental crime.This research is a normative research or library research. In this case, the author choosesresearch on the principles of law, namely the principle of error in corporations. The data used inthis study is secondary data. The data is then analyzed descriptively qualitative. The theoreticalbasis used are identification theory, substitute accountability theory, and functional perpetratortheory.The result of this research shows that corporate errors can be taken based on intentionsor omissions found in the people who become their tools. These errors are not individual, because itis related to the corporate that is collective. Thus, the corporation has errors that is taken from themanagement or the board of directors in carrying out the duties of their absolute functionary. It ishoped that the uniformity of rules for corporations is made as a subject of criminal law so as toprovide certainty regarding criminal rules and consistency and a strong foundation in imposingcriminal liability on corporation.

Abstract

Peran BPD (Badan Pemusyawaratan Desa) merupakan lembaga perwujudan demokrasi dalampenyelenggaraan pemerintahan desa. Perumusan peraturan desa adalah penjabaran dari berbagai kewenanganyang dimiliki oleh desa, tentu saja berdasarkan kebutuhan dan kondisi desa setempat, serta mengacu padahukum dan peraturan yang lebih tinggi. Sebagai produk hukum, peraturan desa tidak boleh bertentangandengan peraturan yang lebih tinggi dan tidak boleh merugikan kepentingan publik. Sebagai produk politik,peraturan desa disusun secara demokratis dan partisipatif, yaitu proses persiapan yang melibatkanpartisipasi masyarakat. Masyarakat memiliki hak untuk mengusulkan atau memberikan masukan kepadakepala desa dan kepala desa dalam proses penyusunan peraturan desa.Penelitian ini dilakukan di Desa Pulau Panjang Hilir, Kecamatan Inuman, Kabupaten Kuansing, dariinformasi di lapangan dan kondisi sosial, menunjukkan bahwa kewenangan lembaga BPD dalamberpartisipasi dalam mempersiapkan APBD sebagian dilaksanakan dan sesuai dengan apa yang diharapkan.memainkan peran optimal. Banyak faktor yang memicu rendahnya kinerja BPD Pulau Panjang Hilir dalammenjalankan fungsi legislasi baik faktor internal maupun eksternal. Faktor internal yang menghambat peranBPD dalam menjalankan tugasnya meliputi tingkat pendidikan anggota BPD yang masih rendah rata-ratauntuk lulusan sekolah dasar, menengah pertama, fasilitas pendukung kerja dan infrastruktur yang masihkurang persyaratan, sehingga sebagai anggota BPD yang berfungsi sebagai badan legislasi desa tidak dapatberfungsi secara optimal.Untuk itu semua pihak yang terlibat dalam pemerintahan desa diharapkan mampu memahami danmenyadari fungsi, peran dan kewenangan masing-masing sehingga ke depan tidak akan ada kesalahpahamantentang posisi antara BPD dan pemerintah desa. Dan sinergi atau kerja sama antara pemerintah desa danBPD harus diperkuat dan mendorong masyarakat desa untuk lebih mengekspresikan aspirasi mereka kepadapemerintah desa dan BPD. Dan pendidikan anggota BPD harus dipertimbangkan karena itu adalah prosestransformasi pengetahuan dari seseorang ke orang lain secara sistematis dan pengembangan dasar. Dengankata lain, pendidikan adalah upaya mendorong pengembangan cara berpikir dan merangsang tumbuhnyapola pikir anggota BPD.

Abstract

Basically, the Corruption Eradication Commission has the duty, authorityand obligation to conduct investigations, investigations, and prosecutions againstcorruption. One of the basis for arriving at the suspicion of false information isstated in Article 163 of the Criminal Procedure Code, from the formulation of thearticle it is known that one of the grounds for arriving at a false testimony is if thewitness's testimony in the hearing is different from the statement contained in theminutes. The judge has the right to assess the evidence of witness testimony andthe authority of the judge because of his position to determine witnesses whoallegedly gave false information in order to be processed in accordance withArticle 174 of the Criminal Procedure Code. The purpose of writing this scheme,namely; First, to find out the investigators of the Corruption EradicationCommission are authorized to determine the suspect providing false informationto witnesses who testify under oath before a court in a corruption case without acourt order. Second, to find out the arrangement or mechanism for determiningsuspects giving false information to witnesses who give testimony under oathbefore a court in a case of corruption based on the Criminal Procedure Code.This type of research can be classified in the type of normative juridicalresearch, because in this study the author conducted a study of the rules andregulations concerning the problem under study.From the results of the research problem there are two main things that canbe concluded. First, the Investigator of the Corruption Eradication Commissionhas the authority to determine the suspect giving false information to witnesseswho testify under oath before a court in a case of corruption without a court orderconstituting a mistake in law enforcement. Second, the arrangement ormechanism for determining the suspect giving false information to witnesses whotestify under oath before a court in a case of corruption based on the CriminalProcedure Code must refer to the provisions of Article 174. The author'ssuggestion, First, It is expected that there is legal certainty as efforts to overcomedifferences in law enforcement against witnesses who commit criminal acts beforea court hearing, judges and investigators must have clear and written limitationsin the legislation. Secondly, it is recommended that investigators respect theexamination process at a court of law not to investigate cases that are beingprocessed in court without any request or order from the case handling judge.Keywords: Law Enforcement - Witness - False Testimony - CorruptionEradication Commission

Abstract

Steps to enhance the dignity and consciousness of the consumer must begin withan attempt to understand the fundamental rights of consumers, which can serve as the basisfor the struggle to realize those rights. In general there are 4 basic rights of consumers,namely the right to obtain security, the right to obtain information, the right to vote, the rightto be heard. Based on this understanding, the authors formulate two problems, namely: First,What is the legal relationship between Consumer users of public transit bus service TransMetro Pekanbaru with Trans Metro bus management Pekanbaru ?, Secondly, Whetherconsumers harmed their rights can sue to the Trans Trans bus Pekanbaru ?.The type of research used by the author is empirical law research or alsoknown as sociological law research, that is research conducted by how toeffectiveness of law apply in society. Kegitan done in collecting data in this researchis document study or library materials. This document or library study includes aquestionnaire.From the results of research there are several problems that can besummarized as follows: First, the emergence of legal relations if the occurrence ofacts against the law. Secondly, the public transportation service user of Bus TransMetro Pekanbaru can provide Criticism and suggestion related to the facility throughthe phone number of complaint in Trans Metro bus Pekanbaru or come directly toCity Transportation Office of Pekanbaru.
