Abstract

Perkembangan bank digital di Indonesia menghadirkan peluang strategis dalam mendukung implementasi green finance sebagai bagian dari agenda keuangan berkelanjutan. Urgensi perubahan iklim dan tuntutan global terhadap integrasi prinsip ESG menjadikan sinergi keduanya relevan untuk dianalisis. Penelitian ini bertujuan mengkaji peran, peluang, dan tantangan bank digital dalam mendorong praktik green finance di Indonesia. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Data bersumber dari bahan hukum primer berupa POJK terkait keuangan berkelanjutan, bahan hukum sekunder berupa artikel ilmiah dan laporan dari lembaga terkait, serta bahan hukum tersier dari informasi daring. Hasil penelitian menunjukkan bahwa bank digital berperan dalam memperluas akses green financing, meningkatkan efisiensi operasional, serta memperkuat transparansi pelaporan. Namun, tantangan muncul terkait green literacy, keterbatasan proyek bankable, risiko greenwashing, serta lemahnya insentif fiskal. Simpulan penelitian menegaskan bahwa optimalisasi peran bank digital dalam green finance membutuhkan sinergi regulasi, inovasi teknologi, dan kolaborasi lintas pemangku kepentingan.

Abstract

This study seeks to examine the counterclaims, also known as reconvention, presented in a breach of contract case as outlined in Decision Number 34/Pdt.G/2025/PN.Bdg, with a focus on the legal grounds used, the court's reasoning, and the resulting legal outcomes within the context of a construction contract. This study employs a normative legal approach, focusing on the case method by examining court rulings, statutory laws, and related legal writings. The findings indicate that the counterclaim was submitted because the first-stage payment for work that had progressed to 30 percent completion was not fulfilled, even though the payment was made through a blank check. The court viewed the action as a breach of contract and ruled that the Plaintiff's suspension of work in the Reconvention was lawful under the terms of the agreement, resulting in a partial approval of the counterclaim. This study shows that recognizing progress in work can create important legal consequences that lead to the need for payment. However, court decisions often focus on formal proof from written documents, which might not take into account the quality of the work as a key part of fulfilling the contract. Therefore, the counterclaim in this case functions as a means of legal protection and also emphasizes the need to balance legal certainty with substantive justice when addressing disputes in construction contracts.

Abstract

Investment in the property sector, particularly in housing projects, is characterized by high capital requirements and significant risks of default. This research aims to analyze the forms of legal protection available to creditors as the aggrieved party in capital loan agreements and to examine the judicial considerations in Decision Number 69/Pdt.G/2025/PN.Jkt.Sel regarding the fulfillment of creditors' rights. The research methodology employed is normative juridical, using a statutory approach and a case approach. Data sources were derived from secondary data, encompassing primary legal materials such as legislation and court decisions, as well as secondary legal materials, including legal literature. The results indicate that legal protection for creditors is categorized into two forms: preventive protection through the drafting of rigorous contractual clauses and the binding of collateral, and repressive protection through breach of contract (wanprestasi) lawsuits to demand compensation or the execution of collateral. In Decision Number 69/Pdt.G/2025/PN.Jkt.Sel, the court affirmed that the debtor’s failure to adhere to the payment schedule in the housing project constitutes a breach of contract, granting the creditor the right to recover the principal capital along with interest and penalties as agreed.
