Abstract

This study clarifies the legal status of the Preliminary Sale and Purchase Agreement (PPJB) within Indonesia’s land transfer framework and delineates the limits of legal protection for good-faith purchasers at the pre-levering stage. The central issue lies in the tension between PPJB’s obligational nature and the publicity principle of land registration, particularly when confronted with third parties who have lawfully acquired a Deed of Sale and Purchase (AJB) and registered their rights. Employing a normative legal method, this research applies a statute approach (UUPA, Government Regulation 24/1997 as amended by 18/2021, Condominium Law, and relevant PUPR regulations), a conceptual approach (subjective–objective good faith, pacta sunt servanda, publicity), and a case approach (judicial tendencies). The findings demonstrate that PPJB creates only a personal claim and does not transfer real rights prior to AJB execution and registration. The “good-faith purchaser” status requires measurable, documented, and provable due diligence. Priority attaches to registered rights held by good-faith third parties, rendering PPJB purchasers’ protection primarily remedial. This study proposes an operational Good-Faith Test Matrix (Minimum Due Diligence) to support objective assessment and dispute prevention.

Abstract

This study aims to conduct an in-depth analysis of the application of a restorative justice approach in resolving criminal offenses arising from land sale and purchase transactions, particularly fraud and/or embezzlement as regulated under Articles 378 and 372 of the Indonesian Criminal Code. This research employs a normative legal research method by integrating statutory, conceptual, and case approaches, and is analyzed qualitatively through systematic and conceptual interpretation. The findings indicate that restorative justice has been normatively accommodated within the Indonesian legal system through Regulation Indonesian National Police Number 8 of 2021 and Regulation Attorney General’s Office Number 15 of 2020. Furthermore, it can be applied in land sale and purchase cases, provided that certain requirements are fulfilled, such as the existence of a settlement agreement and the restitution of the victim’s losses. However, its implementation remains selective and faces several challenges, including the absence of clear limitations and the potential for misuse in practice. Abstrak: Kajian ini diarahkan untuk menelaah secara mendalam penerapan pendekatan keadilan restoratif dalam penyelesaian tindak pidana yang timbul dari transaksi jual beli tanah, khususnya terhadap tindak pidana penipuan dan/atau penggelapan tercantum di Pasal 378 dan Pasal 372 Kitab Undang-Undang Hukum Pidana. Penelitian memakai metode penelitian hukum normatif dengan mengintegrasikan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus serta dianalisis secara kualitatif melalui interpretasi sistematis dan konseptual. Hasil kajian atau penelitian ini menunjukkan bahwa keadilan restoratif secara normatif telah diakomodasi dalam sistem hukum Indonesia melalui Peraturan Kepolisian Nomor 8 Tahun 2021 dan Peraturan Kejaksaan Nomor 15 Tahun 2020, serta dapat diterapkan dalam perkara jual beli tanah sepanjang memenuhi syarat tertentu, seperti adanya perdamaian dan pemulihan kerugian korban. Namun demikian, penerapannya masih bersifat selektif dan menghadapi kendala berupa belum adanya batasan yang jelas serta potensi penyalahgunaan dalam praktik.

Abstract

Corruption remains one of the structural problems that continues to pose a serious challange to the legal system i Indonesia. So Far efforts to combat corruption have largely focused on represive approach through criminal law enforcement. However, such approaches have not been fully effective  in sustainably reducing  corruption rates. Therefore, a more comprehensive approach  is needed through preventive instruments, one of which is anti-corruption education. This study aims to analyze the position of anti corruption education  as a preventive instrumentin law enforcement in Indonesia and to examine the relevance of Article 2,3  and 12 B of the Anti Corruption Law in supportig the Effort. This research employs a normative legal  research method  using a status approach and a conceptual approach. The data used consist primary and secondary legal materials which are analyzed qualitatively. The result of the study indicate that anti corruption education has a strategic position as  a preventive instrument in law enforcement as it is capable of fostering legal awarenessand individual integrity  from an early stage .Furthermore articles 2 and 3  provide a normative basis regarding forms of corruption that must be prevented while Article 12 B on Gratuities  strengthens the importance of public understanding of corruptpractice in everyday life. Thus the integration of penal and non penal aproavhes through anti corruption education is essential in creating a more effective and sustainable lw enforcement in Indonesia.
