Abstract

Legal politics constitutes the fundamental state policy that determines the direction, substance, and implementation of law in order to achieve national objectives. In the Indonesian constitutional system, the 1945 Constitution of the Republic of Indonesia serves as the supreme legal foundation guiding the formulation and development of national legal politics. This study examines legal politics from the perspective of the 1945 Constitution and analyzes its implications for the formation of national law. Employing a normative legal research method, this study applies statutory, conceptual, and historical approaches by analyzing constitutional provisions, legislation, legal doctrines, and scholarly opinions. The findings reveal that the 1945 Constitution provides normative guidance and clear limitations for national legal politics, particularly in upholding the principles of the rule of law, democracy, constitutional supremacy, and the protection of human rights. The Constitution not only functions as the highest legal norm but also as a philosophical and juridical framework that directs legal policy toward achieving justice, legal certainty, and social welfare. Furthermore, legal politics grounded in constitutional values significantly influences the substance of legislation, the legislative process, and mechanisms of constitutional review. A constitutional-oriented legal politics ensures that laws are formulated in a democratic, participatory, and accountable manner while remaining consistent with the objectives of the state as stipulated in the Preamble of the 1945 Constitution. Therefore, strengthening constitutional compliance in legal politics is essential to develop a just, responsive, and socially equitable national legal system in Indonesia

Abstract

Abstrak Politik hukum merupakan arah kebijakan hukum yang ditetapkan oleh negara dalam rangka mencapai tujuan berbangsa dan bernegara sebagaimana tercantum dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dalam konteks pembentukan peraturan perundang-undangan nasional, politik hukum memiliki peran strategis dalam menentukan substansi, bentuk, serta mekanisme pembentukan regulasi agar selaras dengan nilai keadilan, kepastian hukum, dan kemanfaatan. Penelitian ini bertujuan untuk menganalisis konsep politik hukum serta implementasinya dalam proses pembentukan peraturan perundang-undangan di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa pembentukan peraturan perundang-undangan nasional tidak dapat dilepaskan dari konfigurasi politik yang berkembang, sehingga sering kali memengaruhi kualitas dan konsistensi regulasi yang dihasilkan. Oleh karena itu, diperlukan penguatan politik hukum yang berlandaskan pada Pancasila dan konstitusi agar setiap peraturan perundang-undangan yang dibentuk mampu menjawab kebutuhan masyarakat serta menjamin terciptanya sistem hukum nasional yang demokratis dan berkeadilan. Kata kunci: Politik Hukum, Pembentukan Peraturan Perundang-undangan, Hukum Nasional   Abstract Legal politics refers to the direction of legal policy determined by the state in order to achieve the national goals as stipulated in the 1945 Constitution of the Republic of Indonesia. In the context of the formation of national legislation, legal politics plays a strategic role in determining the substance, form, and mechanisms of regulatory drafting to ensure alignment with the values of justice, legal certainty, and expediency. This study aims to analyze the concept of legal politics and its implementation in the process of forming legislation in Indonesia. The research method employed is normative legal research using statutory and conceptual approaches. The findings indicate that the formation of national legislation cannot be separated from the prevailing political configuration, which often influences the quality and consistency of the regulations produced. Therefore, it is necessary to strengthen legal politics based on Pancasila and the Constitution to ensure that every regulation enacted is able to respond to societal needs and guarantee the realization of a democratic and just national legal system.
