INDONESIAPenelitian ini bertujuan untuk menganalisis disharmonisasi regulasi terkait perkawinan beda agama di Indonesia dengan menggunakan perspektif Teori Sistem Hukum yang dikemukakan oleh Lawrence M. Friedman. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan analitis, melalui studi kepustakaan terhadap peraturan perundang-undangan, putusan pengadilan, serta literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa terjadi ketidaksinkronan antara Undang-Undang Perkawinan, Undang-Undang Administrasi Kependudukan, dan Surat Edaran Mahkamah Agung Nomor 2 Tahun 2023 dalam mengatur perkawinan beda agama. Pada aspek substansi hukum, konflik norma menimbulkan ketidakpastian terkait keabsahan perkawinan. Pada aspek struktur hukum, perbedaan interpretasi aparat penegak hukum menyebabkan disparitas putusan dan ketidakseragaman praktik pencatatan. Sementara pada aspek budaya hukum, masyarakat cenderung mencari alternatif di luar ketentuan normatif, seperti menikah di luar negeri atau melakukan konversi agama secara formalitas. Implikasi dari disharmonisasi tersebut berdampak pada ketidakpastian status hukum perkawinan, serta berpotensi menimbulkan persoalan dalam aspek keperdataan, seperti status anak dan harta bersama. ENGLISHThis study aims to analyze the disharmonization of regulations related to interfaith marriage in Indonesia using the perspective of Legal System Theory proposed by Lawrence M. Friedman. The research method used is normative juridical with a legislative, conceptual, and analytical approach, through a literature study of laws and regulations, court decisions, and relevant scientific literature. The results of the study show that there is a missynchronization between the Marriage Law, the Population Administration Law, and the Supreme Court Circular Letter Number 2 of 2023 in regulating interfaith marriage. In the aspect of legal substance, the conflict of norms causes uncertainty related to the validity of marriage. In the aspect of legal structure, differences in interpretations of law enforcement officials cause disparities in decisions and uniformity in recording practices. Meanwhile, in the aspect of legal culture, people tend to look for alternatives outside of normative provisions, such as marrying abroad or converting to religion through formality. The implications of this disharmonization have an impact on the uncertainty of the legal status of marriage, and have the potential to cause problems in civil aspects, such as the status of children and joint property. This study recommends the need for harmonization of regulations through the synchronization of laws and regulations and the affirmation of judicial guidelines in order to realize legal certainty and the protection of citizens' rights consistently.
