Abstract

The increase in the PPnBM rate to 12% in Law 7/2021 on Luxury Goods is a fiscal reform strategy to increase state revenue and control the consumption of luxury goods. This policy aims to broaden the tax base and reduce socio-economic inequality. From a legal perspective, its implementation must uphold the principles of justice, legal certainty, and protection of taxpayer rights. Clear derivative regulations, transparent implementation, and strict supervision are needed to prevent abuse. This paper analyzes the policy through normative and conceptual approaches of tax administration law and fiscal economics.

Abstract

The development of information technology has driven significant transformation in the financial sector through the presence of digital banking services and electronic wallets (e-wallets). Although these innovations improve efficiency and financial inclusion, the use of personal data in their operations poses serious risks such as misuse, illegal access, and data breaches that can harm customers. This study aims to analyze the regulation of personal data protection in Indonesia, the forms of responsibility of service providers, as well as the obstacles and efforts to strengthen its protection. The research method used is normative juridical with a legislative and comparative approach. The discussion results show that although regulations such as the Personal Data Protection Law (UU PDP) and Financial Services Authority Regulations (POJK) exist, personal data protection still faces challenges, including low digital literacy among the public, cyberattack risks, system security weaknesses, and insufficient supervision. Efforts to strengthen protection need to be carried out through massive public education, implementation of global security standards (Security by Design), strict law enforcement, and cross-sector collaboration to create a safe and trusted digital financial ecosystem.

Abstract

Arbitrase internasional merupakan mekanisme vital dalam penyelesaian sengketa bisnis global yang menawarkan efisiensi dan finalitas. Penelitian ini bertujuan untuk melakukan komparasi penerapan arbitrase internasional di Indonesia, China, Eropa, dan Amerika Serikat guna menilai efektivitasnya sebagai instrumen penyelesaian sengketa di luar pengadilan. Menggunakan metode penelitian yuridis-normatif dengan pendekatan perundang-undangan dan konseptual, hasil penelitian menunjukkan bahwa meskipun Indonesia memiliki UU No. 30 Tahun 1999, implementasinya masih menghadapi hambatan intervensi pengadilan melalui proses exequatur dan penafsiran ketertiban umum (public policy) yang luas. Hal ini kontras dengan Amerika Serikat dan Eropa yang menerapkan kebijakan pro-arbitrase dengan tafsir ketertiban umum yang sempit, serta China yang memiliki sistem pelaporan terpusat untuk menjamin konsistensi eksekusi putusan. Selain itu, Indonesia masih tertinggal dalam regulasi eksplisit mengenai arbitrase daring dibandingkan yurisdiksi pembanding. Penelitian menyimpulkan bahwa Indonesia memerlukan reformasi regulasi dengan mengadopsi UNCITRAL Model Law secara penuh guna mempersempit ruang intervensi yudisial, memperkuat kepastian hukum, dan meningkatkan daya saing arbitrase nasional di kancah internasional.
