Abstract

This research aims to legally analyze whether the inactive status of National Health Insurance (JKN) membership can be used as a basis for refusing patients from the perspective of Law No. 17 of 2023 concerning Health. This issue arises from field practices indicating service restrictions against inactive JKN participants, which potentially contradicts the principles of the right to health and non-discrimination. This study employs a normative legal research method with a statutory and conceptual approach. Primary and secondary legal materials are analyzed systematically through legal interpretation and norm harmonization. The results indicate that the right to health services under Law No. 17 of 2023 is a fundamental right that cannot be restricted by administrative membership status. Inactive JKN status lacks a valid legal basis to serve as a reason for refusing patients, particularly when it hinders the fulfillment of the right to health. Furthermore, the study identifies a vacuum in operational norms and a lack of integrated regulation between the Health Law and technical JKN regulations. This research contributes to the development of health law by strengthening a rights-based approach and offering an ideal legal construction that balances the protection of patient rights with the sustainability of national health financing.

Abstract

Decree Law no. 17 of 2023 on Health comes with a new regulation on the responsibility of hospitals for medical negligence. This research aims to examine the juridical impact of the Law's rules on the hospital's liability regime regarding civil, criminal, and administrative liability. This study uses the normative juridical method, which is a statutory and conceptual approach, to examine legal materials through document studies, regulations, literature, and research relevant to the problem of law. The findings reveal that Legislation No. 17 of 2023 concerning Health broadens the legal liability of hospitals as service providers and independent legal entities that are subject to liability. Hospitals need to keep patients safe through the supervision of medical personnel, quality standards, and risk management. These provisions create a multilayer system of accountability that combines the personal responsibility of medical staff with institutional liability, providing greater legal protection for patients and holding healthcare organizations more accountable. The research findings indicate that Legislation No. 17 of 2023 on Health confirms and develops a robust legal basis to reign hospital liability for medical malpractice and foster a structured patient safety culture in healthcare systems.

Abstract

This study normatively analyzes the legal status of the Catholic Church’s annulment within the Indonesian national legal system by comparing the concepts of annulment and divorce. This study is normative legal research that employs statutory and conceptual approaches. The results indicate that annulment in Catholic Church Law is declarative and based on the principle of the indissolubility of marriage, thus being conceptually distinct from divorce in national law. Although annulment shares similarities with marriage annulment, the decisions of ecclesiastical tribunals do not have binding legal force in the national legal system because they are not explicitly regulated by Law Number 1 of 1974 concerning Marriage. This lack of synchronization between canon and national laws creates legal uncertainty and has implications for the protection of Catholic citizens’ rights. This research affirms the necessity of harmonizing legal norms within the framework of legal pluralism to achieve legal certainty and justice in the regulation of marital status in Indonesia

Abstract

Perlindungan hukum terhadap hak asasi orang dengan gangguan jiwa yang terlibat tindak pidana merupakan aspek krusial dalam menjamin keadilan dan penghormatan martabat manusia dalam sistem peradilan pidana Indonesia. Undang-Undang Nomor 18 Tahun 2014 tentang Kesehatan Jiwa memberikan kerangka normatif untuk perlindungan hak-hak orang dengan gangguan jiwa, namun implementasinya dalam proses hukum pidana masih menghadapi berbagai kendala dan kekurangan. Penelitian ini bertujuan untuk mengkaji secara normatif perlindungan hukum terhadap orang dengan gangguan jiwa dalam UU tersebut, mengidentifikasi kelemahan normatif, serta merumuskan formulasi perlindungan hukum yang ideal berdasarkan prinsip-prinsip hak asasi manusia. Metode penelitian menggunakan pendekatan yuridis normatif dengan analisis dokumen hukum primer dan sekunder. Temuan penelitian mengungkapkan bahwa meskipun UU Kesehatan Jiwa sudah mengatur perlindungan dasar, terdapat kekosongan norma dan mekanisme implementasi yang belum optimal, sehingga berisiko menimbulkan diskriminasi dan pelanggaran hak orang dengan dalam proses pidana. Oleh karena itu, diperlukan reformulasi regulasi yang lebih inklusif dan berkeadilan, mengedepankan non-diskriminasi, keadilan restoratif, serta akses rehabilitasi yang memadai. Kajian ini memberikan kontribusi bagi pengembangan kebijakan hukum pidana yang lebih responsif terhadap kebutuhan khusus orang dengan gangguan jiwa di Indonesia.

Abstract

The phenomenon of cohabitation as a form of living together without a legally recognized marriage has become increasingly prominent within Indonesian social dynamics, yet its existence is confronted with criminalization through the provisions of Law Number 1 of 2023 concerning the Criminal Code (KUHP). This study aims to analyze the regulation of cohabitation in the new Criminal Code, assess its compatibility with human rights principles as stipulated in Law Number 39 of 1999 on Human Rights, and understand the influence of social norms in its implementation. Using a normative juridical method with statutory and conceptual approaches, this research examines the tension between public morality, social reality, and the protection of individual rights. The findings show that the criminal provisions on cohabitation in the KUHP are moralistic in nature and not fully aligned with human rights principles, particularly those related to privacy, personal freedom, proportionality, and non-discrimination. Its application in society is also heavily influenced by diverse social norms, creating the potential for selective criminalization. This study concludes that the formulation of Indonesian criminal law needs to be directed toward a more humanistic and human rights-oriented approach, positioning criminal law as ultima ratio and avoiding disproportionate intervention in the private sphere of citizens.
