Abstract

The transformation of the digital economy has encouraged the development of the creator economy which has made TikTok one of the main platforms for content monetization through the commission system (TikTok Affiliate). Although it provides great economic opportunities for content creators and business actors, the practice still faces problems of legal certainty, especially related to the legal relationship between the parties, transparency of the commission mechanism, changes to platform policies, and the protection of the economic rights of creators. This study aims to analyze the legal certainty of the commission system in monetizing TikTok content based on the perspective of contemporary business law enriched by the analysis of Sharia Economic Law. The research uses normative juridical methods with legislative, conceptual, and analytical approaches. Legal materials include the Civil Code, Law Number 1 of 2024 concerning Electronic Information and Transactions, the Consumer Protection Law, Government Regulation Number 71 of 2019, the DSN-MUI Fatwa regarding ju'ālah, samsarah, and wakālah bi al-ujrah contracts, as well as various related literature. The results of the study show that the commission system on TikTok Affiliate is a legally valid contractual relationship based on electronic contracts, but its implementation does not fully reflect legal certainty because there is still a lack of algorithm transparency, unilateral policy changes, an imbalance in bargaining positions, and weak dispute resolution mechanisms. Viewed from the perspective of contemporary business law, the commission system on digital platforms is allowed as long as it meets the principles of contract clarity, fairness, transparency, and avoidance of gharar elements. Therefore, adaptive regulations are needed that harmonize positive laws with sharia principles to strengthen legal certainty, protection of creators' economic rights, and accountable digital platform governance.

Abstract

Anak perempuan merupakan kelompok rentan yang kerap menjadi korban kekerasan dalam rumah tangga (KDRT), baik secara fisik, psikis, seksual maupun penelantaran. kondisi ini menunjukkan bahwa ruang domestik yang seharusnya menjadi tempat aman justru berpotensi menjadi sumber pelanggaran hak asasi anak. penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap anak perempuan sebagai korban kekerasan dalam rumah tangga serta menelaah efektivitas regulasi yang ada dalam memberikan jaminan perlindungan dan pemulihan bagi korban. metode penelitian yang digunakan adalah kualitatif deskriptif yang datanya diperoleh tanpa melakukan observasi langsung ke lapangan dengan pendekatan perundang-undangan dan konseptual, melalui pengkajian Undang-Undang Perlindungan Anak, Undang-Undang Penghapusan Kekerasan dalam Rumah Tangga, serta instrumen hukum terkait lainnya. hasil penelitian menunjukkan bahwa secara normatif negara telah menyediakan landasan hukum untuk melindungi anak perempuan korban KDRT, namun dalam praktiknya masih ditemukan berbagai hambatan, seperti rendahnya pelaporan, lemahnya penegakan hukum, dan kurangnya pemahaman masyarakat. oleh karena itu, diperlukan penguatan peran negara, aparat penegak hukum, serta peningkatan kesadaran masyarakat guna mewujudkan perlindungan hukum yang efektif dan berkeadlian bagi anak perempuan korban kekerasan dalam rumah tangga.

Abstract

This article examines the relationship between freedom of enterprise and economic justice in Indonesia’s constitutional order and Islamic economic law, arguing that Indonesian law recognises no unlimited, freestanding right to enterprise: enterprise freedom is constructed through the right to work and dignified livelihood, equality and legal certainty, property protection, economic democracy, environmental sustainability, and state duties toward vulnerable citizens. Islamic economic law contributes a substantive ethical vocabulary—?adl, maslahah, maq??id al-shar??ah, risk-sharing, the prohibition of riba, gharar and maysir, and the redistributive functions of zakat and waqf—whose justice claim depends on institutional performance rather than formal religious labelling. Using a normative-empirical legal method combining conceptual, statutory, case-study, historical, and comparative approaches (Wiratraman, 2019), the study analyses the 1945 Constitution, key statutory instruments, Constitutional Court decisions on electricity and water, and evidence on Islamic social finance, Islamic banking, Aceh’s Sharia economic legislation, and inequality. The findings indicate a conditional constitutional synthesis: enterprise is legitimate when it expands real capabilities and fair opportunity, and regulation is legitimate when lawful, proportionate, accountable, and directed toward public prosperity. The article proposes an integrated framework in which constitutional economic democracy and maq??id-oriented Islamic economic law mutually reinforce inclusive welfare within Indonesia’s plural legal order.
