Abstract

This research is an Islamic Law Review of the Concept of Nusyuz in Husband and Wife Relations in Banabungi Village, South Buton Regency. The main points of discussion are: a) The concept of Nusyuz in the Islamic Law Perspective in Banabungi Village, South Buton Regency and b) Husband and Wife Relations from the Islamic Law Perspective in Banabungi Village, South Buton Regency. This research uses qualitative research methods, sampling uses non-random sampling/non-probability sampling subjects, the research instrument uses a qualitative approach and the data collection used is observation, interviews and documentation and the data analysis technique used has three stages, namely data reduction, data presentation, and drawing conclusions. The results of this research show that: a) Determining Nusyuz in Banabungi Village is based on the forms of violations committed by the husband/wife during marriage. b) Review of Islamic Law regarding Husband and Wife Relations in Banabungi Village, namely a harmonious family is a family that is balanced and related between husband and wife. And the ideal family according to Islam is the concept of equal partnerships or equal relationships.

Abstract

The Baruga Posambua tradition is a tradition of the people of Bahari Village, South Buton Regency, which is held every three years in November, which is a must that must be carried out. The aim of this research is to find out the form of the ritual procession of the Baruga Posambua tradition in the people of Bahari Village, South Buton Regency and a review of Islamic Law. towards the Baruga Posambua tradition in the people of Bahari Village, South Buton Regency. The method in this research is descriptive qualitative using field research. Collecting data or information by referring to observation, documentation and interview guidelines. Furthermore, data analysis techniques are obtained in the form of field notes, photographs, interview transcripts and method of description, depiction or painting in a factual and accurate manner regarding the facts and phenomena being investigated. The results of research from the Islamic Law Review of the Baruga Posambua Tradition show that this tradition does not conflict with Islamic laws because it has the aim of being a form of gratitude to Allah SWT for the good fortune that has been given, as a form of friendship between communities, as a space for soul mates and a form of cultural preservation. in which there are no elements of polytheism.

Abstract

Lolei Tradition in the Perspective of Islamic Law in Watorumbe Village, Central Mawasangka District, Central Buton Regency. The main discussion is formulated into several research questions, namely: a) how is the implementation of the Lolei tradition, and b) what is the perspective of Islamic law on the implementation of the Lolei tradition and c) how is the Lolei tradition reviewed from the aspects of benefits and harms. This study uses a qualitative method, with data collection using observation, interview and documentation techniques. Data analysis by analyzing data reduction and data presentation and drawing conclusions. This study aims to determine the process of implementing the Lolei tradition, and the perspective of Islamic law on the implementation of the Lolei tradition and the Lolei tradition reviewed from the aspects of benefits and harms. The data sources obtained by the author are informants consisting of traditional figures, religious figures and community figures. The results of the study show that the Lolei tradition is in line with Islamic teachings because its implementation is intended to seek protection from Allah SWT. However, in the process of implementing the Lolei tradition there are still parts that conflict with Islamic teachings. Therefore, community leaders, religious leaders, and traditional leaders, as well as the entire community of Watorumbe Village, need to make changes or eliminate parts that conflict with Islamic teachings so that they are in accordance with Islamic law.

Abstract

This study examines the local wisdom of the Laporo ethnic group, namely the tradition of determining auspicious days, known as kocika in the Ciacia language. This study is then linked to an Islamic legal perspective. The research location is in Bugi Village, Sorawolio District, Baubau City. The focus of this study is (1) the process of calculating kocika for marriage and (2) the Islamic legal perspective on kocika for marriage. This thesis is a qualitative study with an empirical approach. Data collection techniques used were interviews and literature review. Data analysis was conducted using descriptive analysis. The results of this study indicate that, first, the process of calculating kocika (determining auspicious days) for marriage begins with a family meeting, the main benchmark of which is knowing the woman's menstrual period and estimated fertile period. Second, the Islamic legal perspective on kocika, or choosing an auspicious day for marriage, is permissible as long as it does not adhere to the belief that marriages conducted during months forbidden according to the Laporo calendar are bad, as according to Islam all days are good and none are bad. Kocika is an effort to find an auspicious day for marriage and Maslahah mursalah, or utilizing and avoiding harm for the sake of the objectives of sharia. This is intended as an effort to choose a pleasant day that provides benefits to society.
