Abstract

This study aims to identify and explain the implementation of the Authority of the Civil Service Police Unit in Securing Regional Assets of the South Sulawesi Provincial Government. To find out and explain the settlement of violations committed by the Civil Service Police Unit in Safeguarding Regional Assets for the South Sulawesi Provincial Government. This research uses normative-empirical research. The types and sources of law used in this research are document data and secondary data. Methods of collecting data through interviews and documentation, all of the data were analyzed qualitatively and presented in descriptive form. The results of the study show that the authority of the Civil Service Police Unit in securing regional assets of the South Sulawesi Provincial Government is the authority of the delegation, the authority that transfers responsibility to those who are given the authority in this case the regional secretary based on the BKAD letter which is dispositioned to Satpol PP, the delegation's authority is created because of their attribution authority, authority sourced from Law No. 23 of 2014, PP No. 16 of 2018 and Regional Regulation No. 3 of 2017. and Settlement of violations of the Civil Service Police Unit in securing regional assets of the South Sulawesi Provincial Government is carried out by PPNS Satpol PP in coordination and supervision of investigators the police with the process of investigation, examination, summons and solution.

Abstract

Penelitian ini dimaksudkan untuk mengetahui fungsi Camat dalam kampanye Pemilihan Umum tahun 2019 di Kota Makassar menurut Undang-undang Nomor 7 Tahun 2017. Penelitian ini merupakan penelitian lapangan (field research), dengan pendekatan yuridis-empirik, sumber data yang digunakan berupa data primer dan data sekunder, yang diperoleh melalui observasi dan wawancara, data yang terkumpul kemudian dianalisis secara kualitiatif dan selanjutnya disimpulkan. Hasil penelitian menunjukkan bahwa, keberadaaan Camat sebagai kepala wilayah, yang bertanggungjawab terhadap penyelenggaraan pemerintahan ditingkat kecamatan, memiliki fungsi dalam pelaksanaan kampanye Pemilu, fungsi tersebut diatur dalam Pasal Pasal 298 (Ayat) 1 dan Pasal 306 (Ayat) 1 Undang-undang Nomor 7 Tahun 2017. Dalam ketentuan tersebut, Camat dituntut untuk berkoordinasi dengan KPU terkait pelaksanaan sosialisasi atau kampanye di wilayah teritorialnya. Selain itu, Camat juga dituntut untuk memberikan kesempatan yang sama kepada semua peserta Pemilu dalam penggunaan fasilitas umum sebagai sarana dan prasarana untuk melakukan sosialisasi.Kata Kunci: Camat; Kampanye; Pemilu 2019

Abstract

This study aims to identify and analyze efforts to combat sexual violence using the Speak Up approach and the factors influencing it in Makassar. This study employed an empirical approach, collecting primary and secondary data obtained through literature review and interviews with relevant parties, namely the Makassar City Women's Empowerment and Child Protection Office. The data were then processed descriptively and qualitatively. The results indicate that the Speak Up Program implemented by the Makassar City Women's Empowerment and Child Protection Office is a preemptive effort to combat sexual violence because it focuses on raising awareness, strengthening the initial reporting system, and reducing social barriers for victims so that acts of sexual violence can be prevented or intervened as early as possible. Preventive action is taken by increasing awareness, education, and early reporting to prevent crimes of sexual violence. Repressive action is taken by encouraging victims and the community to report cases immediately so that cases can be followed up by law enforcement. The implementation of the Speak Up Program is significantly impacted by several inhibiting factors, including negative stigma against victims, lack of access to information, limited resources, pressure from external parties, and the impartiality of law enforcement officials.

Abstract

Penelitian ini bertujuan menganalisis pelaksanaan fungsi pengawasan Ombudsman Republik Indonesia terhadap pelayanan publik di bidang pertanahan di Kota Makassar berdasarkan Undang-Undang Nomor 37 Tahun 2008 dengan pendekatan normatif-empiris, yaitu membandingkan ketentuan undang-undang dengan praktik pelaksanaannya di Ombudsman RI Perwakilan Sulawesi Selatan. Hasil penelitian menunjukkan bahwa pada tahap perencanaan Ombudsman melaksanakan penerimaan laporan, melakukan pemeriksaan (verifikasi), dan menindaklanjuti laporan; pada tahap pelaksanaan dilakukan investigasi atas prakarsa sendiri, koordinasi dengan instansi terlapor, serta pembangunan jaringan kerja; dan pada tahap pertanggungjawaban dilakukan upaya pencegahan maladministrasi serta pelaksanaan tugas lain yang diamanatkan undang-undang melalui mekanisme pengaduan langsung dan tidak langsung seperti SP4N-LAPOR; namun pelaksanaan fungsi pengawasan tersebut belum optimal karena masih terdapat laporan dugaan maladadministrasi di bidang pertanahan yang tidak dapat dicegah, sementara hambatan dalam pelaksanaannya meliputi keterbatasan sumber daya manusia, rendahnya kesadaran hukum masyarakat, serta kurang kooperatifnya sebagian instansi terlapor. Oleh karena itu, diperlukan penguatan pengawasan proaktif dan peningkatan kerja sama antar pihak guna mewujudkan pelayanan pertanahan yang transparan, akuntabel, dan berorientasi pada kepastian hukum. This study aims to analyze the implementation of the supervisory function of the Ombudsman of the Republic of Indonesia towards public services in the land sector in Makassar City based on Law Number 37 of 2008 with a normative-empirical approach, namely comparing the provisions of the law with the practice of its implementation at the Ombudsman of the Republic of Indonesia Representative Office of South Sulawesi. The results of the study indicate that at the planning stage the Ombudsman carries out report receipt, conducts examination (verification), and follows up on reports; at the implementation stage, investigations are carried out on its own initiative, coordination with the reported agency, and network development; and at the accountability stage, efforts are made to prevent maladministration and carry out other duties mandated by law through direct and indirect complaint mechanisms such as SP4N-LAPOR; however, the implementation of the supervisory function is not optimal because there are still reports of alleged maladministration in the land sector that cannot be prevented, while obstacles in its implementation include limited human resources, low public legal awareness, and lack of cooperation from some reported agencies. Therefore, it is necessary to strengthen proactive supervision and increase cooperation between parties to realize transparent, accountable and legal certainty-oriented land services.

Abstract

The discourse regarding the mechanism for electing regional heads through Regional People’s Representative Councils (DPRD) has re-emerged amidst various problems in the implementation of direct regional elections in Indonesia, including money politics, high political costs, and social polarization. This discourse raises constitutional debates concerning the interpretation of the phrase “elected democratically” as stipulated in Article 18 paragraph (4) of the 1945 Constitution of the Republic of Indonesia, particularly in relation to the presidential system adopted by Indonesia. This study aims to analyze the meaning of democratic principles in the mechanism for electing regional heads and to examine whether the election of regional heads by DPRD is compatible with the principles of democracy within a presidential system. This research is normative legal research employing statutory, conceptual, historical, and case approaches. The legal materials used consist of primary, secondary, and tertiary legal materials analyzed qualitatively through constitutional interpretation and legal reasoning methods. The results of the study indicate that the phrase “elected democratically” should be interpreted as the direct election of regional heads by the people as a manifestation of popular sovereignty and as a constitutional consequence of the presidential system. In a presidential system, executive legitimacy must derive directly from the people in order to maintain the principles of separation of powers, executive independence, and checks and balances. The election of regional heads by DPRD potentially weakens democratic legitimacy, creates political dependence of regional heads on DPRD, opens space for political bargaining, and shifts the character of regional governance toward a quasi-parliamentary model. Therefore, direct regional elections are not merely procedural democratic mechanisms, but also constitute a constitutional necessity in maintaining the consistency of Indonesia’s presidential system and strengthening local democracy
