Abstract

The results of the discussion conclude that the principle of recriminalization or regulation of new criminal acts that were previously not clearly regulated or new articles related to computer crimes and electronic transactions as well as related to the criminal justice system and law enforcement policies to balance the interests of law enforcement of electronic transactions. This shows that the new Criminal Code attempts to combine the principle of substantive justice while maintaining criminal law as a last resort in resolving legal conflicts. The research method used is normative juridical, with a literature study of the New Criminal Code, national legal literature, and scientific articles discussing the principle of ultimum remedium and Criminal Code reform.

Abstract

Penelitian ini bertujuan menganalisis hak mewaris anak dari perkawinan tidak tercatat dengan studi Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan perbandingan hukum, serta dianalisis secara kualitatif melalui studi kepustakaan terhadap bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa Putusan MK Nomor 46/PUU-VIII/2010 memberikan perkembangan penting terhadap pengakuan hubungan keperdataan antara anak dan ayah biologis sepanjang dapat dibuktikan secara hukum melalui penetapan pengadilan. Namun demikian, dalam perspektif hukum Islam, putusan tersebut tidak mengubah konsep nasab sebagai dasar utama pewarisan, melainkan memperkuat perlindungan hak keperdataan anak. Dalam praktik peradilan agama, penerapan putusan ini menunjukkan kecenderungan hakim untuk mengedepankan kepentingan terbaik bagi anak sebagai dasar perlindungan hukum dan kepastian terhadap hak warisnya.

Abstract

The development of the Islamic banking industry has contributed greatly to the economy in the city of Medan. The purpose of this study is to analyze the role of notaries in implementing Islamic financing agreements in the form of notarial deeds in the city of Medan. To analyze the legal certainty of Islamic financing agreements in the form of notarial deeds in the city of Medan. To analyze the reconstruction of the implementation of Islamic financing agreements in the form of notarial deeds in the city of Medan. This type of research is normative juridical, namely research obtained from the results of data collection through literature studies. The data source in this study is secondary data, namely data obtained from literature searches, which come from primary legal materials, secondary legal materials and tertiary legal materials. Based on the research results, it can be understood that the Authority of Notaries in Making Financing Contracts at Islamic Banks in the Form of Notarial Deeds is based on their authority as regulated in the provisions of Article 15 paragraph (1) of the Notary Law. In making financing contracts, notaries follow all provisions of laws and regulations regarding the making of Notarial deeds and all the pillars and requirements for making contracts, and pay attention to the contents of the deed so that they can avoid anything prohibited by Islamic law. Meanwhile, the form of responsibility of notaries for their mistakes in making financing contracts for Islamic banking is in the form of responsibility in terms of civil law, criminal law, administrative law and even responsibility in terms of Islamic law

Abstract

This study discusses the role of notaries in buying and selling transactions related to illegal fishing practices, reviewed from the perspective of law and professional ethics. Illegal fishing is a fishing activity that violates legal regulations, so that it can have a legal impact on the transaction of buying and selling the catch. A notary, as a public official, has a responsibility to ensure that the deeds he or she makes do not conflict with the law and ethics. This research uses a normative juridical method with a legislative and conceptual approach. Data was obtained through literature studies by researching relevant laws and regulations, legal doctrines, and the notary profession code of ethics. The analysis was carried out to identify the extent to which notaries play a role in preventing the legalization of transactions that have the potential to involve the proceeds of illegal fishing. The results of the study show that notaries have an important responsibility to ensure the legality of the object of the transaction, including ensuring that the fishery products traded do not come from illegal fishing activities. In terms of professional ethics, notaries are obliged to reject the making of deeds involving the results of these illegal practices. However, the lack of transparency and oversight of the supply chain of fishery products is often an obstacle. This study recommends strengthening regulations and training for notaries to understand issues related to illegal fishing
