Abstract

The abolition of the Presidential Threshold through Constitutional Court Decision No. 62/PUU-XXII/2024 has sparked debate over political justice and governmental stability. This study analyzes the issue through Imam Al-Mawardi’s perspective on state politics, focusing on leadership, political legitimacy, and the principle of public interest (maslahah). Using a normative legal method with conceptual and case approaches, the findings reveal that removing the threshold risks producing leaders with weak legitimacy, while maintaining an excessively high threshold creates political injustice. The ideal position is to establish a proportional threshold aligned with maslahah and substantive justice.

Abstract

Human rights are an inseparable component of human life, both in the social, economic, religious, political and even educational fields, because these rights are an integral part of every human being since birth. In addition, the context of the discussion of Human Rights cannot be separated from the scope of the state, because it has become an obligation for a country to guarantee and protect this right under any conditions, Indonesia is also one of the countries that provide guarantees and protection for every right. human rights, although in reality its implementation can still be categorized as not conducive, because this can be seen in the development of cases that allude to the issue of upholding human rights in Indonesia. During the reform era in Indonesia, there were several amendments to the 1945 Constitution. These amendments aimed to improve and strengthen the democratic system and protect human rights. In 1999, the first amendment was made to the 1945 Constitution. This research aims to find out the basic legal concept of protecting and enforcing human rights law in Indonesia, besides that it also aims to increase public insight into the importance of human rights values in the context of state life. In this research the author uses a normative approach by examining several materials or literature data which also discusses the issue of basic legal concepts of protection and enforcement.

Abstract

Persoalan pemenuhan terhadap hak para penyandang disabilitas patut diperhatikan lebih intens lagi oleh para pegiat kemanusiaan, hingga detik ini perlakuan diskriminatif terhadap para penyandang disabilitas masih kerap kali terjadi. Belakangan ini ketentuan Pasal 433 KUH Perdata menjadi sorotan publik, lantaran dalam pasal tersebut tercantum redaksi “dungu, sakit otak dan mata gelap,” yang menjadi kriteria pemerintah dalam mengidentifikasi penyandang disabilitas. Tentunya, redaksi pada pasal tersebut sangatlah tidak etis serta mencerminkan adanya klasifikasi ciri-ciri penyandang disabilitas yang berlebihan, diskriminatif dan merendahkan, Oleh karena itu penelitian ini bertujuan untuk menakar sejauh mana pemenuhan hak penyandang disabilitas ditinjau dari hukum progresif, dengan melibatkan pendekatan konseptual dan perundang-undangan. Pada akhirnya, penelitian ini mengungkapkan bahwa hingga saat ini pemenuhan terhadap hak penyandang disabilitas masih belum progresif, lantaran masih didapati fenomena sosial dan hukum yang mencerminkan adanya upaya mendiskreditkan hak-hak para penyandang disabilitas.

Abstract

This research examines the implementation of Law No. 1 of 2023 concerning the Indone- sian Penal Code, specifically Articles 217 and 240, which effectively restrict citizens' rights to express their opinions. Cases such as those involving Ahmad Dhani and Haris Azhar-Fatia highlight how legal provisions intended for protection are instead used to silence dissenting voices. The Constitutional Court had previ- ously clarified in Decision No. 013-022/PUU-IV/2006 that these restrictions on freedom of expression are inconsistent with the constitution. However, the reality on the ground shows that this ruling is not being enforced. This study employs a qualitative approach to thoroughly analyze legal provisions related to defamation of the President and state institutions. The analysis reveals that Articles 217 and 240 of the Penal Code conflicts with human rights principles, particularly freedom of expression. The broad interpretation of these articles poses a significant threat to democracy. The urgency to revise these articles in alignment with democratic values is increasingly evident.
