Abstract

This study aims to examine and analyze the legal protect of Good faith Fiduciary Giver in Transition of Motorized Vehicle Financing Under the Hands This research is a normative legal research by using the approach of legislation, method of concept approach and method of case approach. The theory used in this research is legal protection theory and legal certainty theory The results of this study found that the protection of the law for good-faith parties can take the form of repressive and preventive legal protection as stipulated in the Fiduciary Guaranty Act as well as second-party criminal responsibility in good faith transition under Article 23 paragraph (2) Jo Article 36 UUJF because in performing legal actions not in accordance with the provisions of the Fiduciary Guaranty Act and Article 372 of the Criminal Code.

Abstract

The development of philosophical science spreads to aspects of the operation of law along with the dynamics of human civilization. However, this philosophical concept must be filtered with the essential values, including Indonesia. This is because the fusion of philosophical ideas with elements as stated in the state constitution of a nation must be interpreted and crystallized in various legal products issued by a government. This study aims to describe the Pancasila perspective on the development of legal philosophy in Indonesia and analyze the meaning of 'justice' from a progressive legal perspective. This research is legal research using a conceptual approach and legislation. The legal materials used in this research are primary legal materials and secondary legal materials. These two materials are considered to examine the legal issues raised in this research. The result of this study is that the philosophy of law in Indonesia is based on the precepts of all the principles in Pancasila. Pancasila is actually in line with the flow of legal philosophy, namely Sociological Jurisprudence. This departs from the three dimensions of Pancasila, which is oriented to give birth to harmony from the implementation of rights and obligations in every existing legal subject. Then, the concept of progressive law provides the view that Justice is more oriented as substantive Justice, not procedural Justice. This is because Justice is the essence of the law itself; so that Justice cannot be calculated mathematically, cannot be interpreted purely textually, or can only be said to be 'fair' when there are two people who have the same share as others.

Abstract

Politics and law are two variables that can influence each other in a legal system. Legal politics is a form of state policy carried out through authorized state institutions to establish the desired regulations, which are expected to be used to express what is contained in society and to achieve the desired goals. This research aims to examine the character of statutory legal products, namely the character of legal products of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. This research is normative legal research which makes norms the object of study using a legal approach analyzed using legal political theory. The data collection technique used is literature study. Research findings show that in general the character of the legal product of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage is responsive in view of the birth of the law. However, the provisions of Article 7 paragraph (2) of Law Number 16 of 2019 do not show a responsive or conservative character. The provisions in this article are not in accordance with the spirit of change based on Constitutional Court Decision Number 22/PUU-XV/2017 and seem ahistorical. Theoretically, the conservative character in legal politics is a legal product that is not democratic, different from responsive legal products, namely legal products that accommodate a variety of opinions. Other findings show that there is no judicial institution that has the authority to check the consistency between the provisions of one article or paragraph and another in one form of legal product.

Abstract

Berdasarkan hasil observasi awal yang telah dilaksanakan di SMPN Satap 2 pemenang diperoleh permasalahan dalam pembelajaran matematika yaitu siswa kurang aktif dalam proses belajar mengajar sehingga mengakibatkan motivasi dan prestasi belajar matematika siswa menjadi rendah. Penelitian ini bertujuan untuk mengetahui peningkatan motivasi dan prestasi belajar siswa melalui penerapan metode Active Learning Tipe Learning Tournament pada siswa kelas VII SMPN Satap 2 Pemenang pada materi pokok segiempat semester II tahun pelajaran 2012/2013. Adapun jenis penelitian ini adalah Penelitian tindakan Kelas (PTK). Data dalam penelitian ini adalah data motivasi belajar siswa dan prestasi belajar matematika siswa. Data motivasi belajar siswa diperoleh dengan cara mengisi angket/koisoner, sedangakan data prestasi belajar siswa diperoleh dengan cara evaluasi. Dari hasil analisis motivasi  belajar siswa menunjukkan bahwa terjadi peningkatan yang positif terhadap proses belajar mengajar yaitu dari motivasi belajar siswa dari cukup tinggi menjadi sangat tinggi. Sedangkan hasil belajar siswa terjadi peningkatan yang cukup signifikan, hal ini terlihat dari hasil analisis skor rata-rata prestasi belajar pada siklus I yaitu 68,3 dengan ketuntasan klasikal 69,2%, selanjutnya pada siklus II skor rata-rata hasil belajar adalah 77,9 dengan ketuntasan klasikal 88,5%. Penelitian ini menyimpulkan bahwa penerapan metode Active Learning tipe Learning Tournament dapat meningkatkan motivasi dan prestasi belajar matematika siswa kelas VII SMPN Satap 2 Pemenang pada materi pokok segiempat tahun pelajaran 2012/2013. Saran tindak lanjut, bahwa dalam mengajar hendaknya menggunakan model pembelajaran yang bervariasi seperti penerapan metode Active Learning tipe Learning Tournament. Kepada siswa untuk sering belajar kelompok ataupun berdiskusi dengan temannya mengenai materi yang belum dimengerti

Abstract

This study aims to improve students' interest and learning outcomes in mathematics by using Augmented Reality media. The research is a classroom action study conducted in two cycles. Each cycle consists of four stages: planning, implementation, observation, and reflection. The subjects of this study were 26 students of class VII.2 at SMPN Satap 2 Bayan. Based on the research conducted, it was found that the application of learning media using Augmented Reality can enhance students' interest and learning outcomes in the topic of solid geometry. In the first cycle, students' learning interest reached 62%, and learning outcomes were at 27%. In the second cycle, there was an increase, with learning interest rising to 84% and learning outcomes improving to 88%. This demonstrates that the implementation of learning media using Augmented Reality effectively enhances students' interest and learning outcomes in the topic of solid geometry.
