Abstract

A child custody environment that is not conducive can hamper children's development because the child's rights are not fulfilled properly. In a family environment that is not conducive (broken home), the authority of child custody is often debated and even unclear. In addition to the disruption of the child's custody environment as a result of an unfavorable environment, it is not uncommon for parents of children to choose to transfer custody of their children to be cared for by parties other than the family, or even entrusted to orphanages. In the transfer of the environment of child custody to someone other than the family or to an orphanage, it is necessary to have the legality of the court as a legal basis for care that has various legal effects as a consequence of the transfer of the environment of child custody. On the one hand, the Religious Courts, which are one of the implementing agencies for judicial power in Indonesia, do not have a clear legality basis in examining, deciding, and resolving cases of custody applications filed by other than the family. So that the existence of the Religious Courts in examining, deciding, and resolving cases of a petition for child custody is important to be studied, because given the absence of regulations that clearly regulate the authority for the Religious Courts to hear cases of requests for child care or custody of children submitted by other than family party. This research is field research which is classified as qualitative research that combines theory and practice in the field which produces answers that do not number. The results showed that the religious court can examine, decide and settle cases of child custody applications filed by other than the family with reference to two general foundations, namely the juridical foundation and the philosophical basis.

Abstract

Negara hukum adalah Negara yang tatanannya diatur sebaik-baiknya oleh hukum secara hirarki agar dapat menjaga konsistensi peraturan perundang-undangan, mulai dari derajat yang paling tinggi sampai kepada derajat yang paling rendah, dan konsistensi hirarkinya dapat diuji melalui lembaga yudisial, baik Mahkamah Agung (MA) ataupun Mahkamah Konsitusi (MK). Peraturan Pemerintah Pengganti Undang-Undang (Perppu) adalah salah satu bentuk produk hukum yang terdapat dalam hirarki peraturan perundang-undangan di Indonesia. Perppu adalah produk hukum yang ditetapkan oleh Presiden dalam hal ikhwal kegentingan yang memaksa yang berada pada posisi sejajar dengan undang-undang dalam tingkatan hirarki. Di satu sisi, tidak terdapat regulasi yang secara tegas mengatur kewenangan Mahkamah Konstitusi sebagai Pengadilan Konstitusi (Constitutional Court) untuk menguji perppu, sebagaimana ditegaskan di dalam Pasal 24C ayat (1) UUD 1945, MK hanya dapat menguji undang-udang terhadap Undang-Undang Dasar. Oleh karena itu, kajian terhadap kewenangan MK dalam menguji perppu ini menjadi penting. Adapun penelitian ini adalah penelitian hukum normatif yang menjadikan norma sebagai objek kajian. Kesimpulan dari penelitian ini bahwa Mahkamah Konstitusi (MK) dapat menguji Perppu terhdap UUD 1945, jika Perppu dinyatakan sama kedudukannya dengan undang-undang yang menciptakan norma hukum baru, yang menurut teori peraturan perundang-undangan harus tetap berada pada tatanan hirarki untuk menjalin konsistensi antara peraturan perundang-undangan yang lebih tinggi derajatnya dengan yang lebih rendah sebagaimana diuraikan di dalam artikel

Abstract

The rise of the practice of selling used clothing today as an alternative to fulfilling casual needs at a relatively low cost is quite attractive to various groups. On the other hand, the practice of selling used clothing often causes problems for consumers as a result of the absence of adequate information regarding the origin and quality of the goods sold, so that consumers get clothes that are basically unfit for use without prioritizing the principle of benefit (mashlahah). This research uses normative legal research methods, namely by examining existing legal norms in consumer protection laws and provisions of related legislation and their derivatives using a statutory approach, case approach, and conceptual approach. The results showed that the practice of selling used clothing was not carried out in accordance with the provisions of the applicable laws and regulations and tended to ignore consumer protection and could not guarantee the realization of benefits (mashlahah) in the sale and purchase practice.

Abstract

Politics and law are two variables that can influence each other in a legal system. Legal politics is a form of state policy carried out through authorized state institutions to establish the desired regulations, which are expected to be used to express what is contained in society and to achieve the desired goals. This research aims to examine the character of statutory legal products, namely the character of legal products of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. This research is normative legal research which makes norms the object of study using a legal approach analyzed using legal political theory. The data collection technique used is literature study. Research findings show that in general the character of the legal product of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage is responsive in view of the birth of the law. However, the provisions of Article 7 paragraph (2) of Law Number 16 of 2019 do not show a responsive or conservative character. The provisions in this article are not in accordance with the spirit of change based on Constitutional Court Decision Number 22/PUU-XV/2017 and seem ahistorical. Theoretically, the conservative character in legal politics is a legal product that is not democratic, different from responsive legal products, namely legal products that accommodate a variety of opinions. Other findings show that there is no judicial institution that has the authority to check the consistency between the provisions of one article or paragraph and another in one form of legal product.

Abstract

This article examines the construction of the Indonesian legal system through the theoretical lens of maṣlaḥah mursalah, an Islamic legal principle centered on public interest and benefit. The study contributes to the expansion of Islamic legal scholarship within the realm of legal politics in Indonesia. Employing a normative legal research method, it integrates conceptual, historical, and statutory approaches to examine the relevance and application of maṣlaḥah mursalah in the national legal framework. The findings indicate that maṣlaḥah mursalah can serve as a foundational legal theory for constructing a just legal system, especially one that aligns with societal needs and promotes the common good. The Indonesian legal system's development, when viewed through the prism of maṣlaḥah mursalah, reveals two key dimensions: first, the legal construction rooted in the Pancasila-based system as constitutionally mandated by the 1945 Constitution, and second, the partial institutionalization of Islamic law within the national legal order. This dual structure reflects Indonesia's efforts to harmonize religious values with national legal development, offering a model for integrating Islamic jurisprudence with modern state law.
