Abstract

The closure of all Gold’s Gym Indonesia outlets in 2025 left consumers unable to access prepaid membership and personal training services. PT Fit and Health Indonesia’s concurrent Suspension of Debt Payment Obligations (PKPU) proceedings further complicated the fulfillment of their rights. This study examines the company’s legal liability and the remedies available to affected consumers. It employs a normative juridical method and descriptive analysis of primary, secondary, and tertiary legal materials. The analysis indicates that the company remains liable for losses arising from its failure to provide the agreed services. Law Number 8 of 1999 on Consumer Protection requires business actors to compensate consumers for such losses, while the Indonesian Civil Code provides a basis for liability for breach of contract. PKPU does not extinguish this liability, although it affects how consumers may pursue their claims. Available remedies include a class action, registration of claims in the PKPU proceedings, dispute resolution through the Consumer Dispute Settlement Agency (BPSK), and reporting alleged criminal violations where the elements of an offence are satisfied. The study clarifies how consumer protection, contractual liability, and PKPU procedures interact when prepaid services cease.
