Abstrak Dalam Negara dekomrasi, pemilihan kepala daerah secara langsung merupakan hal yang mutlak untuk dilaksanakan. Namun dengan berbagai kelemahannya, timbul ide untuk melakukan pemilihan Gubernur oleh DPRD. Oleh sebab itu, dalam penelitian ini dirumuskan permasalahan yakni bagaimanakah komparasi efektifitas pemilihan kepala daerah oleh rakya dan oleh DPRD. Metode dalam mengkaji penelitian ini adalah hukum normatif. Dari hasil penelitian penulis, pihak yang kontra terhadap pemilihan gubernur oleh DPRD menyatakan bahwa pemilihan Gubernur oleh DPRD adalah merupakan suatu kemunduran yang luar biasa bagi demokrasi Indonesia. Karena Pemilihan Gubernur oleh DPRD tidak mencerminkan kedaulatan rakyat, sebagaimana dimaksud dalam Pasal 1 ayat (2) UUD 1945. Semntara itu, pihak yang pro terhadap pemilihan gubernur oleh DPRD lebih melihan fakta sosiologis yang terjadi saat ini. Beberapa kelemahan seperti biaya pemilihan langsung gubernur yang terlalu mahal, konflik antar masyarakat hingga persoalan kewenangan gubernur yang memang terbatas dikarenakan titik berat otonomi berada pada kabupaten /kota. Kata kunci : Pemilihan Umum, Rakyat, DPRD Abstrac In a democratic country, direct election of regional heads is an absolute must. However, with various weaknesses, the idea arose to conduct an election for the Governor by the DPRD. Therefore, in this research the problem is formulated, namely how to compare the effectiveness of regional head elections by the people and by the DPRD. The method in reviewing this research is normative law. From the results of the author's research, those who are against the election of governor by the DPRD stated that the election of the Governor by the DPRD was a tremendous setback for Indonesian democracy. This is because the election of the governor by the DPRD does not reflect the sovereignty of the people, as referred to in Article 1 paragraph (2) of the 1945 Constitution. Meanwhile, those who are pro against the election of the governor by the DPRD are more concerned with sociological facts that are currently happening. Some of the weaknesses such as the direct election costs for governors are too expensive, conflicts between communities to the issue of the governor's limited authority because the emphasis of autonomy is on the districts/cities.
