<![CDATA[Development during the Industrialization era resulted in limited land for the community and resulted in conflict in the process of obtaining land rights. The conflict that ocurred, namely the occupation of Forest Areas resulting in the issuance of certificates of land rights over forest areas. The purpose of the paper are to examine and analyze the legal status of land rights issued over forest areas. The research method used by the researcher is normative law research. The result of the research is that the legal position of land title certificates is as a means of proof for rights holders and to ensure the creation of legal certainty in society. Regarding the legal status of the land title certificate in the Bayat Forest Zone dispute case, it must be canceled because in this case the judicial process has proven that the certificate issuance process is above the forest area.Keywords : certificate; forest area; landAbstrakPembangunan pada era Industrialisasi berakibat sulitnya penyediaan tanah bagi masyarakat yang berujung sengketa dalam proses perolehan tanah tersebut. Sengketa yang sering terjadi yaitu pendudukan Kawasan Hutan. Masyarakat yang menduduki suatu Kawasan hutan pada waktu tertentu merasa memiliki tanah tersebut dan berujung pada penerbitan sertipikat dikawasan hutan. Tujuan penelitian ini adalah mengkaji dan menganalisis terkait status hukum hak atas tanah yang diterbitkan di atas Kawasan hutan. Metode penelitian yang digunakan oleh peneliti adalah yuridis normatif. Hasil penelitian adalah kedudukan“hukum sertipikat hak atas tanah adalah sebagai alat pembuktian bagi para pemegang haknya serta demi menjamin terciptanya kepastian”hukum. Status hukum sertipikat hak atas tanah dalam kasus sengketa Kawasan Hutan Bayat harus dibatalkan karena dalam proses peradilan telah terbukti bahwa penerbitan sertipikat berada di atas Kawasan hutan.Kata kunci : sertipikat; kawasan hutan; tanah]]>
