Penerapan Sanksi Bagi Pemilih Yang Mencoblos Lebih Dari Satu Kali Sebagaimana Di Atur Pada Undang-Undang Pemilihan Kepala Daerah

Penelitian ini bertujuan menganalisis alasan pertimbangan hakim dalam menerapkan Pasal 178B UU Pemilihan Kepala Daerah pada Putusan Pengadilan Negeri Takalar Nomor: 31/Pid.Sus/2017/PN Tka, telah atau belum mencerminkan keadilan sesungguhnya, dan faktor-faktor yang mempengaruhinya. Metode yang diterapkan pada penelitian ini adalah penelitan normative Hasil penelitian menunjukkan bahwa alasan pertimbangan Hakim pada Putusan Pengadilan Negeri Takalar Nomor: 31/Pid.Sus/2017/PN Tka dalam penerapan Pasal 178B UU Pemilihan Kepala Daerah , berdasarkan 2 (dua) kategori pertimbangan, yaitu pertimbangan hakim yang bersifat yuridis dan pertimbangan hakim yang bersifat non yuridis. Maka Putusan Pengadilan Negeri Takalar Nomor: 31/Pid.Sus/2017/PN Tka, telah mencerminkan keadilan sesungguhnya, dan (2) Bahwa dalam pertimbangan Hakim pada Putusan Pengadilan Negeri Takalar Nomor: 31/Pid.Sus/2017/PN Tka, terkait penerapan Pasal 178B UU Pemilihan Kepala Daerah, dipengaruhi oleh faktor subyektif dan faktor obyektif, serta faktor raw in put, instrument input, dan enviromental input. The Research objective to analyze the reasons for the judge's consideration in applying Article 178B of the Regional Head Election Law in the Takalar District Court Decision Number: 31/Pid.Sus/2017/PN Tka, whether or not it has reflected real justice, and the factors that influence it. The method applied in this research is normative research. The results show that the reasons for the judge's consideration in the Takalar District Court Decision Number: 31/Pid.Sus/2017/PN Tka in the application of Article 178B of the Regional Head Election Law, are based on 2 (two) categories of considerations, namely the judgments of judges that are juridical in nature and those of judges that are non-juridical. Then the Takalar District Court Decision Number: 31/Pid.Sus/2017/PN Tka, has reflected true justice, and (2) That in the judge's consideration in the Takalar District Court Decision Number: 31/Pid.Sus/2017/PN Tka, related the application of Article 178B of the Regional Head Election Law, is influenced by subjective and objective factors, as well as raw input, instrument input, and environmental input factors
