PELAKSANAAN HAK PELAYANAN KESEHATAN BAGI NARAPIDANA YANG TERJANGKIT COVID-19 DI LEMBAGA PEMASYARAKATAN KELAS II A KENDAL

Abstract

Abstrak: Penelitian ini bertujuan untuk mengetahui pelaksanaan pelayanan kesehatan bagi Narapidana yang terjangkit Covid-19 di Lembaga Pemasyarakatan Kelas II A Kendal serta hambatan yang dihadapi oleh aparat di Lembaga Pemasyarakatan Kelas II A Kendal. Penelitian ini merupakan penetilian empiris, bersifat deskriptif dengan menggunakan pendekatan kualitatif. Jenis data yang digunakan adalah data primer dan sekunder. Teknik pengumpulan data dilakukan dengan metode penelitian lapangan dan studi pustaka yang dianalisis dengan metode kualitatif dengan metode interaktif. Hasil penelitian menunjukkan bahwa pelaksanaan hak kesehatan terhadap Narapidana yang terjangkit Covid-19 di Lembaga Pemasyarakatan Kelas II A Kendal belum maksimal, dikarenakan tidak semua prosedur dalam Peraturan Menteri Hukum dan HAM RI Nomor M.HH.02.UM.06.04 Tahun 2011 dan Instruksi Direktur Jenderal Pemasyarakatan Nomor PAS-08.OT.02.02 Tahun 2020 belum dilaksanakan dengan baik. Tidak maksimalnya pelaksanaan hak kesehatan tersebut juga dikarenakan adanya beberapa hambatan yang dihadapi oleh Lembaga Pemasyarakatan Kelas II A Kendal, yaitu Lembaga Pemasyarakatan Kelas II A Kendal dalam kondisi overcrowded, terbatasnya SDM tenaga kesehatan, dan kurangnya sarana dan prasarana di dalam Lembaga Pemasyarakatan Kelas II A Kendal.Kata Kunci: Kesehatan, Narapidana, Covid-19 Abstract: This research aims to describe the implementation of health services for prisoners infected with Covid-19 in second class A Kendal Penitentiary and the obstacles faced by officers at second class A Kendal Penitentiary. This research is an empirical research, descriptive in nature using a qualitative approach. The types of data used are primary and secondary data. Data collection techniques were carried out using field research methods and literature studies which were analyzed using qualitative methods with interactive methods. The results showed that the implementation of health rights for prisoners infected with Covid-19 at the second class A Kendal Penitentiary was not optimal, because not all procedures in the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number M.HH.02.UM.06.04 of 2011 and the Director's Instructions General of Corrections Number PAS-08.OT.02.02 of 2020 has not been implemented properly. The non-optimal implementation of the right to health is also due to several obstacles faced by the second class A Kendal Penitentiary second class A Kendal Penitentiary in an overcrowded condition, limited human resources for health workers, and the lack of facilities and infrastructure within the second class A Kendal Penitentiary.Keywords: Health, Prisoners, Covid-19
