Abstract

The purpose of this study is to find out how the application of khiyar principles in online buying and selling, conduct a case study of object discrepancies in the shopee marketplace, and find out the inhibiting factors that affect the application of khiyar Suppression. Case Study of Online Buying and Selling, Case Study of Object Discrepancy. The type of research used in this research includes descriptive qualitative methods. Data collection methods include interviews and documentation. The data obtained were analyzed in three steps: data reduction, data presentation, and conclusion drawing. The results show that the application of khiyar in online buying and selling on object discrepancies in practice has applied khiyar, but in terms of knowledge and literacy, buyers and sellers do not fully understand khiyar. This applies both in terms of knowledge and literacy of khiyar. I do not fully understand khiyar. The Shopee Marketplace website uses the Khiyar practices of "Khiyar Aib", "Khiyar Syarat", and "Khiyar Ru'yah". Kiyar Aib refers to the right of complaint that a buyer has when receiving a defective product. The term Khiyar Syarat refers to the grace period that Shopee gives buyers to file a complaint. And Khiyar Ru'yah concerns the right of complaint that a buyer has because he cannot directly see the ordered goods at the expiration of the contract.
