PENYELESAIAN PERKARA TINDAK PIDANA RINGAN PADA TINGKAT GAMPONG MELALUI PENERAPAN RESTORATIVE JUSTICE

Penelitian ini tentang proses penyelesaian perkara tindak pidana ringan pada tingkat gampong dengan mekanisme penerapan restorative justice. Hasil penelitian menunjukkan bahwa penyelesaian perkara tindak pidana ringan pada tingkat gampong dapat diselesaikan melalui penerapan restorative justice. Sebelum adanya aturan mengenai kebijakan restorative justice, di Aceh telah mengenal peradilan adat gampong yang berpedoman pada Qanun Aceh No. 10 Tahun 2008 tentang Pembinaan Kehidupan Adat Istiadat.  Penerapan restorative justice pada perkara tindak pidana ringan pada tingkat gampong tidak terlepas dari ketentuan qanun tersebut. Proses penyelesaian perkara tindak pidana ringan pada tingkat gampong dengan penerapan restorative justice dilakukan secara transparan, adil, dan tanpa paksaan. Penyelesaian perkara dengan penerapan restorative justice, lebih memperhatikan kondisi korban, dimana pelaku bertanggung jawab dalam proses pemulihan korban untuk kembali kepada keadaan semula.Kata Kunci ; Restorative Justice, Tindak Pidana Ringan, Penyelesaian Perkara.This research is about the process of resolving minor criminal cases at the village level using the mechanism for implementing restorative justice. The results of the research show that the resolution of minor criminal cases at the village level can be resolved through the application of restorative justice. Before there were regulations regarding restorative justice policies, in Aceh there was familiar gampong customary justice which was guided by Aceh Qanun No. 10 of 2008 concerning the Development of Traditional Life.  The application of restorative justice in minor criminal cases at the gampong level cannot be separated from the provisions of the qanun. The process of resolving minor criminal cases at the gampong level by implementing restorative justice is carried out transparently, fairly and without coercion. Resolving cases by applying restorative justice pays more attention to the victim's condition, where the perpetrator is responsible for the victim's recovery process to return to their original condition.Keywords ; Restorative Justice, Minor Crimes, Case Settlement.
