Abstract

Dunia kedokteran gigi saat ini terus berkembang seiring dengan kemajuan teknologi dalam bidang kedokteran gigi. Tidak mampu disangkal bahwa peraturan yang ada akan mengikuti perkembangan teknologi kedokteran gigi. Pernyataan ini sangat logis, karena hukum berfungsi untuk melindungi setiap tindakan individu di bawah ketentuan hukum. Oleh karena itu, dalam konteks kedokteran dan kedokteran gigi, payung hukum untuk kesehatan diatur dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, yang mempertimbangkan bahwa negara menjamin hak setiap warga negara untuk mencapai kehidupan yang baik, sehat, dan sejahtera, baik lahir maupun batin, demi mencapai tujuan nasional dalam melindungi seluruh bangsa Indonesia dan memajukan kesejahteraan umum, sesuai amanat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.Untuk menganalisa kedudukan hukum tukang gigi dalam pelayanan kesehatan dan hak public. sesuai dengan perundang-undangan.Yuridis Normatif dengan Statute Approach dan Conseptual Approach sumber bahanhukum berupa sumber bahan hukum primer, sekunder dan tertier.Tukang Gigi Hanya dianggap sebagai Pelaku Usaha dan tidak ada undang-undang kesehatan yang mengatur terkati tukang gigi, hanya pada aturan turunan pada Permenkes No. 39 Tahun 2014, peraturan hanya sebagai batasan namun tidak secara komprehensif, sehingga jika tukang gigi merugikan masyarakat atau pasien sebagai konsumen maka harus ada pertanggung jawaban hukum baik Perdata maupun Pidana serta perlindungan hukum yang pasti.Pemerintah dan tenaga kesehatan diharapkan memberi edukasi lewat penyuluhan kesehatan gigi dan mulut di masyarakat bagaimana resiko pengerjannya, pemerintah seharusnya mengupayakan untuk memberi pelayanan kesehatan gigi dan mulut yang terjangkau dimasyarakat, serta sanksi hukum bagi` tukang gigi illegal .Abstract: The field of dentistry is continuously developing along with advancements in dental technology. It is undeniable that existing regulations will follow the developments in dental technology. This statement is very logical because the law functions to protect every individual action under the provisions of the law. Therefore, in the context of medicine and dentistry, the legal umbrella for health is regulated in Law Number 17 of 2023 on Health, which considers that the state guarantees the right of every citizen to achieve a good, healthy, and prosperous life, both physically and mentally, in order to achieve the national goal of protecting all Indonesian people and promoting the general welfare, in accordance with the mandate of the 1945 Constitution of the Republic of Indonesia.To analyze the legal position of dental technicians in healthcare services and public rights in accordance with legislation.Normative Juridical with Statute Approach and Conceptual Approach, using primary, secondary, and tertiary legal materials.Dental technicians are only considered as business actors, and there are no health laws regulating dental technicians, except for a derivative regulation in the Ministry of Health Regulation No. 39 of 2014. The regulation serves as a limitation but is not comprehensive. Therefore, if dental technicians harm the public or patients as consumers, there must be legal accountability, both civil and criminal, as well as clear legal protection.The government and healthcare workers are expected to provide education through dental and oral health counseling to the public about the risks of dental work. The government should strive to provide affordable dental and oral healthcare services to the public and impose legal sanctions on illegal dental technicians
