<![CDATA[Penelitian ini mengkaji pemenuhan restitusi bagi korban kejahatan setelah adanya Peraturan Mahkamah Agung Nomor 1 Tahun 2022 (Perma 1/2022). Regulasi ini memperkenalkan mekanisme baru yang memungkinkan permohonan restitusi setelah adanya putusan inkracht, melengkapi aturan sebelumnya dalam Peraturan Pemerintah Nomor 43 Tahun 2017 yang menjelaskan pengajuan selama proses penyidikan, penuntutan dan persidangan. Jenis penelitian yang diterapkan adalah penelitian normatif dengan menggunakan studi kepustakaan dan analisis peraturan perundang-undangan terkait dalam pengumpulan data. Hasil penelitian menunjukkan bahwa meskipun Perma 1/2022 memberikan opsi lain bagi korban dalam mengajukan permohonan restitusi tetapi eksekusi pemberian restitusi tersebut tetap tidak memiliki daya paksa terhadap pelaku. Dengan demikian, diperlukan regulasi yang lebih tegas agar pemenuhan restitusi bagi korban kejahatan dapat terealisasi. Kata Kunci: Perlindungan Hukum, Restitusi, Korban Tindak Pidana. Abstract This study examines the fulfillment of restitution for victims of criminal offenses after the enactment of Supreme Court Regulation Number 1 of 2022 (Perma 1/2022). This regulation introduces a new mechanism that allows for restitution applications after a decision has become final, complementing the previous rules in Government Regulation Number 43 of 2017, that explains submissions during the investigation, prosecution and trial processes. Type of research applied is normative research using literature studies and review of related laws and regulations in data collection. The outcome of study show that although Perma 1/2022 provides other options for victims in applying for restitution, the execution of the restitution still does not have coercive force against the perpetrator.
