<![CDATA[It is very important to resolve problems that arise as a result of giving an inheritance that violates the rules and requirements as well as the legitime portie of the legitimate heir. By studying how inheritance arrangements must be in accordance with applicable provisions, namely the Civil Code, it is an effort to minimize the occurrence of problems and the rights of other people are not harmed; legal force of will; and the legal impact of wills on legitimate inheritance rights according to the Civil Code. In the Civil Code, Legitime portie is the minimum portion of inheritance that must be given to certain heirs. This provision limits a person's freedom in making a will so that they cannot ignore the rights of the heirs who are entitled to legitimate inheritance. This article aims to analyze the legal position of legitime portie, its influence on the freedom to make a will, and how this arrangement protects the rights of heirs. The method used in this research is a normative juridical method with an approach to law, doctrine and relevant cases. The research results show that the legal portie arrangement aims to maintain a balance between the right to freedom of will and the moral obligation to fulfill the rights of certain heirs. Abstrak Sangat penting untuk menyelesaikan masalah yang muncul sebagai hasil dari pemberian warisan yang melanggar peraturan dan persyaratan serta legitime portie ahli waris legitimaris. Dengan cara mempelajari bagaimana pengaturan pewarisan harus sesuai dengan ketentuan yang berlaku yaitu KUHPerdata merupakan suatu upaya untuk meminimalisir terjadinya permasalahan dan hak orang lain tidak dirugikan; kekuatan hukum surat wasiat; dan dampak hukum surat wasiat pada hak waris legitimaris menurut KUHPerdata. Dalam KUHPerdata, Legitime portie adalah porsi minimum warisan yang wajib diberikan kepada ahli waris tertentu. Ketentuan tersebut memberi batasan kebebasan seseorang dalam membuat surat wasiat sehingga tidak dapat mengabaikan hak para ahli waris yang berhak atas legitime portie. Artikel ini bertujuan untuk menganalisis bagaiman kedudukan hukum legitime portie, pengaruhnya terhadap kebebasan membuat surat wasiat, serta bagaimana pengaturan tersebut melindungi hak ahli waris. Metode yang digunakan dalam penelitian ini yaitu menggunakan metode yuridis normatif dengan pendekatan undang-undang, doktrin, dan kasus-kasus relevan. Hasil penelitian menunjukkan bahwa pengaturan legitime portie bertujuan menjaga keseimbangan antara hak kebebasan berwasiat dan kewajiban moral untuk memenuhi hak-hak ahli waris tertentu.]]>
