Abstract

Abstract The uneven distribution of health facilities to fulfill the rights of patients in the Social Security Administration Agency for Health (BPJS Kesehatan) in several regions has led to potential disputes between patients and health service providers, causing discomfort and anxiety triggered by a lack of transparency and communication between hospitals and BPJS Kesehatan patients. This study aims to analyze hospital health system regulations for BPJS Kesehatan patients and evaluate whether these regulations are in line with the principle of fairness. This study uses a qualitative descriptive method, with data collection conducted through case studies. Data analysis involves identifying and evaluating the regulatory framework of the healthcare system and the principles of fairness that have not been fully implemented in hospital services for BPJS Kesehatan patients. This creates a high risk of disputes, where alternative dispute resolution is needed in these transactions. Keywords: Health Services, Hospitals, Dispute Resolution.   Abstrak Ketidakmerataan distribusi fasilitas kesehatan untuk memenuhi hak pasien di Badan Penyelenggara Jaminan Sosial Kesehatan (BPJS Kesehatan) di beberapa wilayah menyebabkan potensi sengketa antara pasien dengan penyedia pelayanan kesehatan yang menimbulkan ketidaknyamanan dan kecemasan yang dipicu kurangnya transparansi dan komunikasi antara rumah sakit dan pasien BPJS Kesehatan. Penelitian ini bertujuan untuk menganalisis regulasi sistem kesehatan rumah sakit bagi pasien BPJS Kesehatan dan mengevaluasi apakah regulasi tersebut sejalan dengan prinsip keadilan. Penelitian ini menggunakan metode deskriptif kualitatif, dengan pengumpulan data dilakukan melalui studi kasus. Analisis data melibatkan identifikasi dan evaluasi kerangka regulasi sistem layanan kesehatan serta prinsip keadilan yang belum diterapkan secara maksimal dalam layanan rumah sakit bagi pasien BPJS Kesehatan. Sehingga rawan adanya sengketa dimana peran alternatif penyelasaian sengketa dibutuhkan dalam transaksi tersebut. Kata Kunci: Pelayanan Kesehatan, Rumah Sakit, Penyelesaian Sengketa.
