Abstract

Consumer dispute resolution in Indonesia is explicitly regulated under Law Number 8 of 1999 concerning Consumer Protection, which provides space for non-litigation settlement through Alternative Dispute Resolution (ADR). The application of ADR, particularly through the Consumer Dispute Settlement Agency (BPSK), reflects the implementation of the principle of fast, simple, and low-cost justice as mandated in Article 2 paragraph (4) of Law Number 48 of 2009 on Judicial Power. This research employs a normative legal method with a statute approach and a conceptual approach. Data were obtained from literature studies covering legislation, legal doctrines, and relevant court decisions. The results of the study indicate that ADR through BPSK serves as an effective mechanism to provide legal certainty, protect consumer rights, and ensure access to justice, particularly for consumers harmed by business actors. However, the effectiveness of ADR still faces several challenges, including limited human resources, low consumer awareness of ADR mechanisms, and the emerging complexity of disputes in the digital trade sector (e-commerce). Therefore, strategies to improve BPSK’s performance are required through regulatory optimization, the use of digital technology in dispute resolution, and capacity building of human resources, so that ADR mechanisms can become more adaptive, responsive, and relevant to the dynamics of consumer protection in Indonesia.

Abstract

Article 7 of Law No. 56 PRP of 1960 regulates the term of agricultural land mortgages, which is 7 years. After this period, the mortgage holder is obliged to return the land to its owner without paying a ransom. However, in practice, the Minangkabau indigenous community still widely practices land mortgages with varying terms and conditions. Court decisions in cases of disputes over communal land mortgages also implement different provisions. Some implement the provisions of Article 7 of Law No. 56 PRP of 1960, while others apply the provisions of Minangkabau customary law. This can be evidenced by the issuance of Supreme Court Decision Number: 1540K/Pdt/2005 dated June 19, 2006, which accommodates the provisions of Article 7 of Law No. 56/Prp/1960 concerning agricultural land mortgages without redemption money, and the Solok District Court Decision on case number: 05/Pdt.G/2003/PN.SLK dated April 20, 2004, which decided the case based on Article 7 of Law No. 56 Prp of 1960. The practice of pawnbroking that is not in accordance with Law No. 56 Prp of 1960 Article 7 has caused confusion among the people of West Sumatra. This has resulted in the people of Nagari Koto Gadang, Gunung Talang District, having different views on Law No. 56 Prp 1960 Article 7 on the Implementation of Pawnbroking. The research method used in this study is empirical juridical.

Abstract

The purpose of this study is to examine the differences in the judges' considerations in Decision Number 1749/Pdt.G/2018/PA.Tbn and Decision Number 2012/Pdt.G/2024/PA.Sby regarding polygamy requests based on high sexual desire. This research is normative in nature, using a legislative and case-based approach. The results of the research show that the judge in Decision Number 1749/Pdt.G/2018/PA.Tbn rejected the petition because the alternative requirements of Article 4 paragraph (2) and the cumulative requirements of Article 5 paragraph (1) were not met. The judge interpreted extensively that the wife's obligations were not limited to serving biological needs, and the petitioner's income was deemed insufficient. Conversely, in Decision Number 2012/Pdt.G/2024/PA.Sby, the petition was granted because the requirements of Article 4 paragraph (2) and Article 5 paragraph (1) were deemed to have been met. The judge made a teleological interpretation and assessed that the petitioner was financially capable and had met the requirements. The majority opinion of scholars regarding court decisions that reject or grant polygamy petitions is that some scholars allow polygamy as an alternative for men who have a strong desire, provided that they are fair and provide sufficient financial support, while some scholars do not allow polygamy if it is done for the reason of having a high biological desire but without a clear purpose. This disparity in decisions is due to legislation and requirements that originate from the judge himself.

Abstract

Dispute resolution through the courts is carried out by filing a lawsuit against the party. The lawsuit is filed with the intention of obtaining legal protection for the rights of one party and forcing the other party to fulfill their obligations after the mediation process has failed. The lawsuit has to fulfill the formal and material requirements, including the formulation of the petition. The petition should not have a negative sentences structure and have to meet the formal requirements for the drafting of a petition. A negative petition gives the other party the opportunity to file an exception of lawsuit. This research was normative juridical research with analytical descriptive specifications. This research used a statutory approach and a case approach. The data used was secondary data with primary and secondary legal materials obtained from literature studies. The primary legal material is laws and regulations. Secondary legal materials are in the form of literature. The data was collected by the literature study method. The data was presented with normative text and analyzed with qualitative normative methods to obtain conclusions. The results of the study show that for petition that have negative sentences structure, the defendant can file an exception to the lawsuit and the legal consequence is that the lawsuit is declared Niet Onvankelijke Verklaard.

Abstract

This paper analyzes the practice of combining breach of contract and tort lawsuits in Indonesia, with a focus on the Supreme Court Decision No. 4268 K/Pdt/2022. Initially, the case was qualified as a breach of contract by the District Court (Decision No. 48/Pdt.G/2020/PN.Bdg) and the High Court (Decision No. 115/Pdt/2021/PT.Bdg), but later requalified as a tort by the Supreme Court. This study aims to examine the practice of combining breach of contract and tort in Indonesian civil procedure and to analyze the judge’s considerations in changing the legal qualification. This research uses a normative juridical method with statutory and case approaches. Data were collected through literature study of primary legal materials. The analysis used is prescriptive analysis. The results show that in practice, the combination of breach of contract and tort claims is not permissible if they are not closely related, as it may lead to an unclear lawsuit. However, if both are closely connected, systematically separated, and clearly explained, such combination is allowed. In Decision No. 4268 K/Pdt/2022, the claim was considered valid because both legal bases were related to the same object and events, and were presented separately.

Abstract

Descente and constatation are two legal terms in civil procedure law that often cause confusion because they are considered to be the same but are actually different. This is because both descente and constatation involve direct examination conducted outside the courtroom. Descente or on-site inspection is regulated in Article 153 HIR/180 RBg. which is an action at the evidence stage in civil proceedings carried out by a judge outside the courtroom when necessary by directly visiting an object of examination at the location where the object is located, while constatering is an act of verification at the execution stage carried out by examining the object of examination directly at its location to ensure that the object is in accordance with what is stated in the court decision. The existence of descente is very important and even mandatory to provide clarity on an event in a civil trial as stipulated in the Supreme Court Circular Letter (SEMA), namely SEMA Number 7 of 2001, SEMA Number 10 of 2020. Likewise, the existence of constatering is also no less important. The Supreme Court, through the execution guidelines issued by the Directorate General of General Courts, requires the court to conduct constatering before the eviction execution is carried out. With constatation, the court ensures that the object being executed is in accordance with the verdict and prevents errors in execution and/or execution that exceeds the verdict. Research on descente and constatation is important to clearly identify the differences between the two. Research on descente and constatering is important so that the differences between the two can be clearly identified.

Abstract

This study analyzes the implementation of the prudential principle in banking, as mandated by Article 8 of Law Number 10 of 1998 in conjunction with Article 2 of Law Number 7 of 1992, in the context of credit disbursement in Sumenep Regency. The prudential principle serves as a key foundation for maintaining financial stability and mitigating credit risk. The research focuses on three banks operating in the region Bank Syariah Indonesia (BSI) KCP Sumenep, Bank Jatim KCU Sumenep, and Bank BPRS Bhakti Sumekar and seeks to evaluate how the principle is operationalized, while identifying key barriers and institutional responses. A qualitative method is adopted, using in-depth interviews and observational techniques to gather relevant data. Findings show that each bank has consistently applied the 5C and 3R principles and utilizes the Financial Information Service System (SLIK) from OJK to assess borrower risk. Despite this, several systemic challenges persist. These include inadequate legal enforcement mechanisms against defaulting debtors, limited public financial literacy, and internal organizational pressure related to credit targets. While infrastructural support appears sufficient, the overall impact of the prudential principle on reducing non-performing loan rates remains suboptimal. The study argues for regulatory reforms that embed prudential requirements more firmly within statutory law, rather than leaving them to soft regulations. Additionally, strengthening institutional capacity and enhancing the ethical competence of banking personnel are considered vital steps to reinforce effective credit governance.

Abstract

This study analyzes the effectiveness of mediation in resolving land disputes in Indonesia and Malaysia through a comparative approach. The scope of the study encompasses: (1) the mechanisms and legal basis of land dispute mediation in Indonesia; (2) the mechanisms and legal basis in Malaysia; and (3) the similarities, differences, and determinants of mediation success in both countries. Employing a normative-juridical method supported by secondary empirical data including institutional reports, case records, and official publications the analysis examines mediation stages, mediator roles, dispute scope, and the binding force of agreements. The findings indicate that mediation effectiveness is significantly influenced by institutional design, mediator competence, transparency of land data, certainty of rights status, and party compliance. Furthermore, this study presents a tabulation of success and failure rates over the past five years to observe resolution trends. Comparative findings confirm that procedural harmonization, enhanced mediation quality, and strengthened enforcement of agreements are pivotal for achieving expeditious, cost-effective, and equitable dispute resolution. This research serves as a strategic reference for policymakers and practitioners in strengthening mediation as an alternative dispute resolution mechanism in the region.

Abstract

Abstract Disputes are an inevitable consequence of the dynamics of legal relations in society, requiring effective, efficient, and fair dispute resolution mechanisms. Non-litigation mediation is an important instrument in resolving disputes outside of court, both in Indonesia and Singapore. This article aims to analyze the role of non-litigation mediation in dispute resolution and compare the legal, institutional, and implementation frameworks in Indonesia and Singapore. This study uses a normative juridical method with a regulatory, comparative, and conceptual approach. The results show that although both countries recognize mediation as an alternative to dispute resolution, Singapore has a more integrated and professional system supported by a strong culture of legal compliance, while in Indonesia, non-litigation mediation still faces normative and implementation obstacles. This study emphasizes the importance of strengthening regulations, institutionalizing mediators, and harmonizing dispute resolution systems to improve the effectiveness of non-litigation mediation in Indonesia. Mediasi non-litigasi menjadi salah satu instrumen penting dalam penyelesaian sengketa di luar pengadilan, baik di Indonesia maupun Singapura. Artikel ini bertujuan untuk menganalisis peran mediasi non-litigasi dalam penyelesaian sengketa serta membandingkan kerangka hukum, kelembagaan, dan implementasinya di Indonesia dan Singapura. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, komparatif, dan konseptual. Hasil penelitian menunjukkan bahwa meskipun kedua negara sama-sama mengakui mediasi sebagai alternatif penyelesaian sengketa, Singapura memiliki sistem yang lebih terintegrasi, profesional, dan didukung oleh budaya kepatuhan hukum yang kuat, sedangkan di Indonesia mediasi non-litigasi masih menghadapi kendala normatif dan implementatif. Studi ini menegaskan pentingnya penguatan regulasi, institusionalisasi mediator, dan harmonisasi sistem penyelesaian sengketa guna meningkatkan efektivitas mediasi non-litigasi di Indonesia. Abstract

Abstract The increasing number of cases filed in court shows the need to optimize dispute resolution mechanisms outside of litigation. Non-litigation mediators play a strategic role in preventing disputes from escalating to court proceedings through a dialogical, participatory, and interest-based approach. This article aims to examine the role and effectiveness of non-litigation mediators in reducing the court caseload through a comparative study between Indonesia and Italy. This study uses a normative juridical method with a regulatory, comparative, and institutional approach. The results show that Italy has strongly institutionalized the role of mediators through mandatory mediation mechanisms and a strict mediator certification system, thereby reducing the number of litigation cases. Meanwhile, in Indonesia, the role of non-litigation mediators is still complementary and faces challenges in terms of regulation, professionalism, and the legal culture of society. This study emphasizes the importance of strengthening the legal and institutional framework for non-litigation mediators as a preventive instrument to reduce the increase in disputes in court. Keywords: Mediation; Case Load; Italy   Abstrak Meningkatnya jumlah perkara yang masuk ke pengadilan menunjukkan perlunya optimalisasi mekanisme penyelesaian sengketa di luar jalur litigasi. Mediator non-litigasi memiliki peran strategis dalam mencegah eskalasi sengketa menuju proses peradilan melalui pendekatan dialogis, partisipatif, dan berbasis kepentingan para pihak. Artikel ini bertujuan untuk mengkaji peran dan efektivitas mediator non-litigasi dalam mereduksi beban perkara pengadilan melalui studi komparasi antara Indonesia dan Italia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, komparatif, dan kelembagaan. Hasil penelitian menunjukkan bahwa Italia telah menginstitusionalisasikan peran mediator secara kuat melalui mekanisme mediasi wajib dan sistem sertifikasi mediator yang ketat, sehingga mampu menekan jumlah perkara litigasi. Sementara itu, di Indonesia, peran mediator non-litigasi masih bersifat komplementer dan menghadapi tantangan dalam aspek regulasi, profesionalisme, serta budaya hukum masyarakat. Penelitian ini menegaskan pentingnya penguatan kerangka hukum dan kelembagaan mediator non-litigasi sebagai instrumen preventif untuk menekan peningkatan sengketa di pengadilan.
