Abstract

Abstract:Artikel ini menganalisis Perbandingan hukum tentang Penerapan Konvensi PBB Anti Korupsi (United Nation Convention Against Corruption) Dalam Sistem Hukum Nasional Indonesia Dengan Malaysia. Tujuan artikel ini adalah untuk membandingkan Undang-undang Tipikor Indonesia dan Malaysia setelah meratifikasi UNCAC. Metodologi penelitian ini adalah menggunakan metode penelitian normatif dengan pendekatan komparatif. Hasil dari penelitian ini membuktikan bahwa Indonesia dan Malaysia sama-sama sudah mengkriminalisasi ketentuan UNCAC. Sedangkan yang menjadi perbedaan adalah di Indonesia masih terdapat beberapa kendala yang dihadapi, yakni terdapat ketentuan-ketentuan UNCAC yang belum diterapkan pada Undang-undang No 31 Tahun 1999 Jo. Undang-undang No. 20 Tahun 2001, yaitu terkait dengan penyuapan terhadap pejabat publik asing dan pejabat organisasi internasional publik, perdagangan pengaruh, dan penyuapan di sektor swasta. Kemudian dalam pemberian saksi bagi koruptor kesamaan dari UU Tipikor Indonesia dan Malaysia adalah sama-sama memberikan sanksi berupa pidana penjara dan denda dan yang membedakan adalah di Malaysia tidak menerapkan sanksi pidana mati kepada koruptor sedangkan di Indonesia masih memberlakukan pidana mati kepada koruptor dan pidana mati akan terus berlaku hingga berlakunya KUHP baru. Kata kunci: Perbandingan Hukum; Peraturan perundang-undangan; United Nation Convention Against Corruption, Indonesia, MalaysiaAbstract : This article analyzes the legal comparison of the implementation of the United Nation Convention Against Corruption in the Indonesian and Malaysian National Legal Systems. The purpose of this article is to compare the Indonesian and Malaysian Anti-Corruption Laws after ratifying UNCAC. The methodology of this research is to use normative research methods with a comparative approach. The results of this study prove that Indonesia and Malaysia have both criminalized the provisions of UNCAC. While the difference is that in Indonesia there are still several obstacles faced, namely there are UNCAC provisions that have not been applied in Law No. 31 of 1999 Jo. Law No. 20 of 2001, namely related to bribery of foreign public officials and officials of public international organizations, trading in influence, and bribery in the private sector. Then in the provision of witnesses for corruptors, the similarity of the Indonesian and Malaysian Corruption Laws is that they both provide sanctions in the form of imprisonment and fines and the difference is that Malaysia does not apply the death penalty to corruptors while in Indonesia it still applies the death penalty to corruptors and the death penalty will continue to apply until the enactment of the new Criminal Code. Keywords : Comparative law,Law and Regulation, United Nation Convention Again Corruption, Indonesia, Malaysia
