<![CDATA[Studi ini memiliki tujuan untuk mengkaji diferensiasi status hukum seseorang dalam sistem peradilan pidana di Indonesia beserta implikasi yuridis atas status pelaku dalam penghentian penyelidikan melalui mekanisme keadilan restoratif. Metode penelitian dalam studi ini adalah yuridis normatif yang didasarkan atas pendekatan konsep dan perundang-undangan. Hasil analisis mengindikasikan bahwasanya sistem peradilan pidana menganut prinsip diferensiasi fungsional yang melahirkan adanya perbedaan status hukum seseorang di setiap tahapan acara pidana. Penetapan status pelaku pada tahap penyelidikan menimbulkan ketidakpastian hukum sebab pada tahapan tersebut aparat masih mencari ada atau tidaknya suatu peristiwa pidana dan tidak dapat melakukan penetapan tersangka maupun upaya paksa. ABSTRACT This study aims to analyze the differentiation of a person’s legal position in the criminal justice system in Indonesia along with the juridical implications for status of the perpetrator in stopping the investigation through the restorative justice mechanism. The research method in this study is normative legal research with conceptual and statutory approach. The findings of the study indicate that the criminal justice system adheres to the principle of functional differentiation which gives birth to differences in a person’s legal status at each stage of criminal proceedings. The determination of the status of the perpetrator at the investigation stage creates legal uncertainty because at the stage the authorities are still looking for the existence or not of a criminal event and can’t determine the suspect or coercive efforts.]]>
