Abstract

Nusa Penida is an island which located on southeast of Bali and separated by the Badung Strait. By a variety of tourist pulling magnets to come to Nusa Penida, it also gives effect to the occurrence of crime. The purposes of the research are to develop the science of law, especially in the field of criminal law and to know and study the type and frequency of crime in Nusa Penida Tourism Area so that it can be constructed effective countermeasures formulation. The method used in the achievement of research objectives, methods of approach Juridical Empirical, namely legal research by way of existing facts approach by way of conducting observations and research through in-depth interviews of the object research. The result of the research shows that there are many types of criminal acts in Nusa Penida area, the most often frequency is the persecution of 24 reports, then theft of 12 reports, then another conventional crime based on data obtained from 2014 until 2017, crimes of a conventional type as stipulated in the Criminal Code and there are crimes that are classified as specific criminal acts such as narcotics abuse. Some obstacles are the existence of darknumber by reason; the omission of the community such as perceiving such acts as cock fighting, seeing guests using addictive drugs, there is also not want to take a risk by  reporting an incident, even the police sometimes do not take action or ignore a suspected incident is a crime because it avoids the occurrence of threats to the apparatus itself. Criminalization committed against such crimes as stipulated by the Criminal Code, namely Article 351, 362, 184, 338, 406, 385, 310, 187, 303, 368 and 285. However, there are also crimes threatened with the provisions of the law outside the Criminal Code : Law No. 23 of 2004 on Elimination of Domestic Violence and Law No. 22 of 2009 on Road Traffic and Transportation. There are other obstacles in relation to law enforcement in Nusa Penida crime, which is still unclear authority between Nusa Penida Police Station and Klungkung Police because of the type of crime they handled.

Abstract

The Writing of ?The Synergicities of Policies and Strategies of Prevention  Terrorism?s Crime of Bali Province? are aimed to develop legal science in general and particular in the field of criminal?s law as well as knowing and studying the synergy between roles and strategies from the government, law enforcers and the community and to find, to analyze, to review and to provide legal solutions to obstacles in the effort to prevent terrorism in crime of Bali Province so it can be constructed to be an effective counter measures formulation. The method used in the achievement of the goal is approach Juridical Empirical method, namely legal research with facts approach by observation and in-depth interviews on object of research. The research was conducted on Bali Police, Kesbangpolinmas Bali, FKPT, FKUB, MUDP, and Religious figures in Bali. The results disclosed that each agency / organization / institution / individual has carried out the obligations according their tasks effectively and strive synergize the policies and strategies of prevention in terrorism. There are a few obstacles ranging from funding, facilities, quality-quantity of human resources to the constraints associated with legislation. By identifying several issues and to find the best solution for more effective prevention of acts of terrorism in synergy and sustainable.

Abstract

Taxes are mandatory contributions from taxpayers to the state which are compelling based on Constitution without receiving direct compensation, in addition; taxes are used for the greatest prosperity of the people.However, there were allegations of irregularities in the tax sector in the case of the leak of the Panama Papers documents. Several businessmen, leaders and state officials were mentioned on Panama Papers, including those who come from Indonesia. Various motives or backgrounds for their participation on Panama Papers, so that it was suspected there were allegations of tax evasion and tax avoidance. Based on those allegations, the question that arose was whether participation on the Panama Papers is Tax Evasion and or Tax Avoidance and how the national criminal law is regulated in this regard. The type of research used is normative research, namely legal research which is carried out based on the norms and principles of the laws and regulations related to tax crime.The result of the research showed that the case study Panama Papers case can be classified as tax evasion because the indication leads to the embezzlement of tax. Even if it is classified as tax avoidance, the perpetrator should still have moral responsibility because tax avoidance is actually a smuggling law (in fact, it is not in accordance with the philosophy of the tax law passed).   Keywords: Juridical analysis, The Punishment, Tax Evasion, Tax Avoidance

Abstract

Reform of the National Criminal Law is absolutely necessary with political, practical and sociological considerations. The amend of Criminal Code also include adjustments of the punishment aims, which leads to restorative justice. Likewise the sanctions for criminal offense in adat law, the punishment is less than optimal if only imposed the freedom deprivation to the perpetrator's, it is necessary to make efforts in restoring the situation (balance).This type of research is normative research, by analyzing norms and legislation related to the aim of punishment in customary offenses. The results of the research that is the aim of customary sentencing is not specifically regulated in positive law, but customary criminal law have the power to apply, based: Article 18 B paragraph (2) of The 1945 State Constitution of the Republic of Indonesia, Emergency Law No. 1 of 1951 on Temporary Measure in Organizing the Unity of the powers and procedure of Civil Courts, Law No. 48 of 2009 on Judicial Power, Law No.39 of 1999 on Human Rights, and the Supreme Court Decisions, among others: (1) Decision No. 1644K / Pid / 1988 dated May 15, 1991; (2) Decision No. 984 K / Pid / 1996 dated January 30, 1996. In the positive law, there is a reflection of restorative justice as a concept that developed in modern criminal law in line with the purpose of sentencing the customary offenses. The aim of sentencing as ius constituendum is formulated in Article 55 paragraph (1) of the 2017 Criminal Code Concept which includes resolving conflicts that arise, restoring balance, and bringing sense of peace and secure in the community, which is in line with customary criminal sanctions because of the visible values of customary law; resolve conflicts, restore balance, and bring a sense of peace in society. Keywords: Analysis, Purpose of Sentencing, Criminal Law Reform, Customary Criminal Act

Abstract

Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Pasal 28H ayat (1) menegaskan bahwa setiap orang berhak hidup sejahtera, lahir dan batin, bertempat tinggal, dan mendapatkan lingkungan hidup yang baik dan sehat. Negara bertanggung jawab untuk menjamin pemenuhan hak akan tempat tinggal dalam bentuk rumah yang layak dan terjangkau. Pembangunan rumah susun dan konsumen yang akan membeli dan menempati untuk memperhatikan akan pentingnya status hak atas tanah tempat dibangunnya rumah susun tersebut sehingga tidak menimbulkan masalah dikemudian hari baik bagi investor rumah susun maupun terutama terhadap kepentingan konsumen pembeli rumah susun. Dari latar belakang tersebut, maka penulis akan menganalisa permasalahan sebagai berikut: Mengapa terjadinya perubahan Undang-Undang No. 16 Tahun 1985 menjadi Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun? dan Bagaimanakah Pengaturan pemberian Hak Guna Bangunan atau Hak Pakai di atas Hak Milik dalam Rumah Susun setelah berlakunya Undang-Undang No. 20 Tahun 2011 tentang Rumah Susun? Penulisan ini menggunakan metode normative. Kesimpulan yang diperoleh, pengaruh globalisasi, budaya, dan kehidupan masyarakat serta dinamika masyarakat menyebabkan Undang-Undang No. 16 Tahun 1985 dilakukan perubahan menjadi Undang-Undang No. 20 Tahun 2011 tentang Rumah Susun. Pemberian Rumah Susun dapat dilakukan di atas Hak Guna Bangunan atau Hak Pakai di atas tanah Hak Milik berdasarkan Peraturan Pemerintah No. 40 Tahun 1996 tentang Hak Guna Usaha, Hak Guna Bangunan, dan Hak Pakai Atas Tanah.

Abstract

Artikel ini membahas kewenangan Badan Narkotika Nasional Kota (BNNK) Denpasar dalam penerapan rehabilitasi bagi penyalahgunaan narkotikaserta menganalisis implementasi aturan mengenai rehabilitasi terhadap penyalah guna narkotikaoleh BNNK Denpasar. Tulisan ini merupakan penelitian hukum yang mengkombinasikan karakteristik penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan dan adopsi terhadap model socio-legal researchberkaitan dengan pelaksanaan penelitian lapangan ke BNNK Denpasar dalam rangka menelusuri data, memperoleh informasi dan melakukan wawancara (interview). Artikel ini menyimpulkan bahwa BNNK memiliki kewenangan dalam penerapanrehabilitasi bagi penyalahgunaan Narkotika sebagaimana diatur di dalam Peraturan Presiden Republik Indonesia Nomor 23 Tahun 2010 tentang Badan Narkotika Nasional dan sejumlah Peraturan Kepala BNN. Dalam pelaksanaan kewenangantersebut, BNNK mendapat pembinaan teknis dan supervisi Pencegahan dan Pemberantasan Penyalahgunaan dan Peredaran Gelap Narkoba (P4GN) di bidang rehabilitasi dari BNN Provinsi. Tulisan ini juga menyimpulkan bahwa secara garis besarnya,BNNK Denpasar telah mengimplementasikan aturan mengenai rehabilitasi terhadap penyalah guna narkotika yang dapat dilihat dari pelaksanaan sosialisasi rehabilitasi gratis bagi pengguna narkotika, penyediaan tempat rehabilitasi, danpemberian fasilitas transportasi bagi orang yang mengikuti program rehabilitasi di luar Bali.
