<![CDATA[The development of climate litigation has significantly strengthened the role of courts in environmental protection and constitutional adjudication within emerging democracies. As climate change increasingly leads to ecological degradation, social vulnerability, and environmental conflicts, courts are becoming central actors in enforcing environmental rights and holding governments accountable. Despite the growing constitutional recognition of environmental rights, procedural inequality continues to limit effective access to environmental justice. This article examines the relationship between climate litigation, environmental constitutionalism, and procedural environmental justice, focusing on judicial approaches, procedural barriers, and constitutional protection in emerging democratic legal systems. The study employs a normative-comparative legal method supported by a socio-legal approach through an analysis of climate adjudication practices in Indonesia, Colombia, India, and Brazil. The findings reveal that the principal obstacles in climate litigation include limited legal standing, evidentiary asymmetry, inadequate public participation, procedural formalism, and unequal access to judicial remedies. The study also identifies divergent judicial approaches ranging from progressive judicial activism and rights-based environmental constitutionalism to procedural restraint and pragmatic constitutional balancing.
