The role of Layanan Terpadu Satu Atap in fulfilling the rights of Indonesian migrant workers

Abstract

This study examines the legal certainty of the arrangement of Layanan Terpadu Satu Atap (LTSA) in fulfilling the rights of Indonesian Migrant Workers (PMI) at the stages of placement agreements and employment contracts, as well as civil liability for losses suffered by PMI in the implementation of LTSA. This is a legal study employing statutory and conceptual approaches, with primary, secondary, and tertiary legal materials. The findings indicate that LTSA has been designed as an integrated service instrument to ensure the orderly placement of PMI from the pre-placement stage. However, this certainty has not yet been fully optimized, as it still depends on inter-agency coordination, careful document verification, and supervision of the contents of the agreements. On the other hand, the losses experienced by PMI cannot be viewed merely as administrative matters; rather, they must be understood as civil issues that give rise to legal consequences for parties who are negligent or who breach their obligations. Therefore, strengthening LTSA is necessary so that it functions not only as a service facility, but also as a legal protection mechanism capable of preventing breach of contract, closing gaps that may cause losses, and ensuring effective restitution of PMI’s rights
