Legal Certainty of the Transfer of Ownership Rights of the Winner of the Execution Auction Reviewed from the Legal Deed of Submission (Levering)

Abstract

This study examines the certainty of the legal transfer of ownership through the process of sale and purchase and execution auctions, reviewed from the legal act of delivery (levering). The problem arises because the auction minutes, as valid evidence of the transfer of rights juridically, have not always been followed by the material handover when the auction object is still in the debtor's possession, so that the auction winner has not been able to enjoy his rights in real terms. The purpose of this study is to test the legal certainty of the use of levering in execution auctions and to examine the position of the execution of vacating (eksekusi pengosongan) as an effort to improve the transfer of ownership rights. Empirical legal research with statutory and conceptual approaches is used in this study. This research is supported by primary data collected through interviews and secondary data in the form of legal materials at various levels. The data are analyzed qualitatively. The findings of the study show that the legal arrangement has guaranteed the transfer of rights juridically through the auction minutes, but has not expressly guaranteed the material handover. As a result, the auction winner must take legal action in the form of a vacating execution to gain physical control of the object. Thus, the legal certainty of the auction winner is juridically strong but not fully effective in factual terms.
