<![CDATA[This study analyzes gold mining activities conducted by local communities in the Muara Batang Gadis River, Kotanopan District, Mandailing Natal Regency, based on Law Number 3 of 2020 and the perspective of siyāsah dustūriyyah. This study aims to examine the legal framework governing community mining permits, the implementation of licensing requirements for community gold mining activities, and the exercise of governmental authority in the legalization process. This research employs an empirical juridical method using statutory, conceptual, and socio-legal approaches. Primary data were obtained through interviews with the Head of Kotanopan District and community miners, while secondary data were collected from legislation, scholarly literature, and relevant documents. The data were analyzed descriptively and qualitatively by comparing legal provisions with empirical conditions concerning the status of the People's Mining Area (WPR), People's Mining Permit (IPR), and governmental authority. The findings show that community gold mining activities do not yet have IPRs because the mining location has not been designated as a WPR, which constitutes the territorial basis for applying for an IPR. The community has submitted its aspirations to the government for WPR designation and access to legalization. From the perspective of siyāsah dustūriyyah, the government is required to exercise its authority based on the principles of al-‘adālah, al-maṣlaḥah, and amānah by providing legal certainty and facilitating the legalization process in accordance with applicable laws.]]>
