Abstract

An authentic deed made by a notary has perfect proof power because it is made by an authorized public official, including the power of proof outwardly, formally, and materially. In practice, notarial deeds are often the object of criminal cases, especially forgery of Deeds, causing problems regarding the implications of criminal decisions on the status of validity and strength of proof of the deed. This study analyzes the legal considerations of judges in decision number 73/PID/2023 / PT.BDG related to the crime of forgery of authentic deeds by notaries and its implications for the status of validity and strength of proof of Deeds. The method used is juridical normative with legislation and case approach, utilizing primary legal materials in the form of legislation and court decisions, as well as secondary legal materials in the form of books, journals, and relevant legal literature. The results showed that a criminal verdict against a notary does not automatically cause a deed to be null and void; the validity and strength of the evidence are still assessed based on civil law regarding the terms of validity of the deed and the principle of proof. However, if it is proven that there is a forgery that affects the truth of the deed, the deed may lose its authenticity and its strength of proof is degraded, potentially even declared to have no strength of proof, depending on the proof of the forgery.
