Abstract

Free legal aid represents the fulfillment of citizens’ constitutional rights to equality before the law and access to justice. This study examines the provision of free legal aid by the Regional Office of the Ministry of Law of West Sumatra Province and the implications of budget efficiency following Presidential Instruction Number 1 of 2025 for disadvantaged communities. It applies an empirical juridical method with a descriptive analytical approach. Data were collected through library research, review of legislation, and interviews with the Regional Office and accredited Legal Aid Organizations, then analyzed qualitatively. The findings show that legal aid is delivered through cooperation between the Regional Office and verified and accredited Legal Aid Organizations. The Regional Office acts as regulator, facilitator, supervisor, mentor, and budget manager, while direct services are provided by Legal Aid Organizations. Budget efficiency reduces the number of cases that can be funded, disrupts reimbursement mechanisms, and limits service coverage. It also shifts part of the state’s financial responsibility to Legal Aid Organizations, advocates, and even aid recipients. Therefore, budget efficiency should not merely mean expenditure reduction, but must uphold justice, proportionality, service continuity, and protection of disadvantaged people’s rights to ensure effective and equitable access to justice.
