Abstract

The development of digital technology has given rise to the Metaverse as a virtual space that immersively and continuously integrates social, economic, and cultural activities. The emergence of the Metaverse has introduced new forms of ownership in the form of digital assets, such as Non-Fungible Tokens (NFTs), virtual land, and digital identities, which possess tangible economic value. This is reflected in the value of national crypto-asset transactions, which reached approximately IDR 650.6 trillion throughout 2024, with 22.9 million registered user accounts. However, this growth has not been accompanied by adequate legal resilience. Nearly 20 million web-based cyberattacks targeted crypto assets in Indonesia throughout 2024, while the National Cyber and Encryption Agency (Badan Siber dan Sandi Negara/BSSN) recorded a sharp increase in the number of national cyberattacks in 2025. The gap between the rapid growth of the digital economy and the slower development of the legal framework constitutes the starting point of this research. This study aims to analyze the urgency of establishing digital security norms within the Metaverse and to formulate an ideal legal framework for the protection of digital assets from a constitutional law perspective. This research employs a normative juridical method using statutory, conceptual, and comparative approaches. The findings indicate that Indonesian regulations remain sectoral and have yet to adequately accommodate the complexity of the Metaverse, thereby creating a legal vacuum that threatens legal certainty and the constitutional rights of citizens. This study recommends the establishment of a comprehensive legal framework based on digital constitutionalism as a means of protecting citizens' digital rights within virtual spaces.
