This study analyzes the construction of protection for well-known trademarks through the concept of "essential similarity" and the level of legal certainty regarding its application in Indonesia. This normative legal research—employing statutory, conceptual, case-based, and historical approaches—reveals that protection for well-known trademarks is available through both preventive and repressive mechanisms, yet the parameters for determining "essential similarity" lack full uniformity. Assessment should consider dominant elements, visual and phonetic similarity, the relationship between goods or services, trademark reputation, likelihood of confusion, and bad faith.
