Abstract

The development of religious art has given birth to the practice of using various Arabic songs, although the text sung is not always shalawat. This study examines the law on the use of Arabic songs at religious events from the perspectives of figures from Nahdlatul Ulama and Muhammadiyah in Surabaya. This study uses empirical legal research methods with qualitative and comparative approaches. Primary data is obtained through interviews and observations, while secondary data is obtained through literature studies of books, journal articles, and relevant scientific works. The analysis is carried out descriptively and comparatively, examining the basis of legal considerations, the position of melody, the content of the lyrics, the purpose of use, and the ethical limitations of both perspectives. The results of the study showed that both informants allowed the use of Arabic songs, provided the lyrics did not contradict sharia, did not contain immoral elements, and were used for good purposes. The difference lies in the orientation of argumentation. Nahdlatul Ulama figures emphasized more on the cultural context, 'urf, maslahah, adab, and the function of cultural da'wah. Meanwhile, Muhammadiyah figures emphasized the substance of worship, the absence of sharia provisions regarding certain melodies, and caution so that artistic expressions are not sashrined as worship. These findings show that differences in the thinking styles of NU and Muhammadiyah figures do not always lead to legal differences, but can give rise to common points through different argumentation frameworks.
