Abstract

The advancement of information technology has given rise to a new form of crime known as identity theft, namely the unlawful misuse of a person’s personal data for material or immaterial gain. The proliferation of personal data breaches in Indonesia, as reflected in the Bjorka hacking case, underscores the urgency of examining this digital crime from the perspective of Islamic criminal law. This study aims to analyze the position of identity theft as a modern jarimah within fiqh jinayah and to formulate proportional sanctions. The research employs a normative legal method with conceptual, statutory, and comparative approaches, examining primary sources of fiqh jinayah and Indonesian data-protection regulations through qualitative content analysis and deductive reasoning. The findings show that identity theft has no explicit textual basis in hudud or qishash, and is therefore classified as jarimah ta’zir whose sanction is delegated to the ruling authority (ulil amri). The elements of jarimah are fulfilled through al-kadhib, akhdh al-mal bi ghayr haqq, and tajassus. The principle of maqashid al-shari’ah, particularly hifz al-mal and hifz al-’ird, legitimizes proportional ta’zir sanctions that are educative, preventive, and restitutive in addressing cybercrime in Indonesia.
