ABSTRACTThe agreement is the agreement of both parties to do an act. Agreements are very often used in everyday life, both under contract and notarial agreement. In the contents of the agreement the parties make in accordance with the principle of freedom of contract. Agreement under the hands of frequent problems caused by parties because the strength of the agreement is binding. Therefore, the need of Notary's role in making the notarial agreement deed so that the parties can achieve their respective objectives and secure if one day there will be one of the parties wanprestasi then notariil agreement can be used as legal evidence. The purpose of writing this journal is to know and analyze the role of Notary in making the deed of notarial agreement. The theory used is the theory of legal protection related to notarial agreement deed made Notary can protect the parties in case of dispute or wanprestasi. The method used in the writing of this journal is literature method review books against books related to the theme of the journal that I created and also sourced from several journals from the internet. In making the notarial agreement deed, the notary needs to pay attention to the things that are prohibited in making the agreement, therefore the role of the Notary is very important in the making of Notariil agreement deed.Keywords: Notary's Role, Agreement, Notary Act, Notary ABSTRAKPerjanjian adalah kesepakatan kedua belah pihak untuk melakukan suatu perbuatan. Perjanjian sangat sering digunakan dalam kehidupan sehari-hari, baik perjanjian dibawah tangan maupun perjanjian notariil. Dalam isi perjanjian para pihak membuat sesuai dengan asas kebebasan berkontrak. Perjanjian dibawah tangan sering saja terjadi masalah santar pihak karena tidak kuatnya perjanjian itu mengikat. Untuk itu diperlukannya peran Notaris dalam membuat akta perjanjian notariil agar para pihak dapat mencapai tujuan masing-masing dan aman jika suatu saat nanti ada salah satu pihak yang wanprestasi maka akta perjanjian notariil tersebut dapat dijadikan sebagai alat bukti yang sah. Tujuan dari penulisan jurnal ini adalah untuk mengetahui dan menganalisa peran Notaris dalam pembuatan akta perjanjian notariil. Teori yang digunakan adalah teori perlindungan hukum yang berkaitan dengan akta perjanjian notariil yang dibuat Notaris dapat melindungi para pihak jika terjadi sengketa ataupun wanprestasi. Metode yang digunakan dalam penulisan jurnal ini adalah metode literatur kaji pustaka terhadap buku-buku yang berhubungan dengan tema jurnal yang saya buat dan juga bersumber dari beberapa jurnal dari internet. Dalam membuat akta perjanjian notariil, notaris perlu memperhatikan hal-hal yang dilarang dalam membuat perjanjian, untuk itu peran Notaris sangatlah penting dalam pembuatan akta perjanjian Notariil.Kata kunci: Peran Notaris, Perjanjian, Akta Notariil, Notaris

This study aims to determine the strength of the deed made under hand as evidence in court, and is there a function legalization and Waarmerking the deed made under hand can provide additional strength of evidence in court. Focused on the research objectives, the formulation of the problem is as follows: First, What is the function of the legalization and Waarmerking deed made under hand in evidence during the trial Court? Second, Do deed made under hand on legalization and in Waarmerking by notaries can be canceled by a judge in court?The research method used is the method of juridical-normative approach. Specifications in this research is descriptive analytical. The data collection method used in this research is secondary data in the form of primary legal materials that legislation, secondary law namely literature, scientific papers, and tertiary legal materials namely legal materials that support primary legal materials and secondary law. While the methods of data analysis using qualitative data analysis.The results showed Legalization and Waarmerking function on deed made under the hand give assurance to the judge about the date, signature, identity of the parties to the agreement, thus helping to judge in terms of proof. Deed made under hand on Legalization and in Waarmerking by notary can be canceled by a judge even though the task of the judge in the case only to share the burden of proof to prove, but ex officio judge can not cancel a deed if not requested cancellation. This is because judges are not allowed to decide unsolicited, so as a deed can be canceled if it does not meet the elements of subjective and objective elements.Keywords: Legalization; Deed; Notary.

The idea of a legal state demands the state administration and the government must be based on law and provide assurance of the basic rights of the people as stipulated in the law. Notary as a general official is appointed by the state, he/she does not receive honorarium from the State, but receives honorarium for legal services provided in accordance with his authority in accordance with Article 36 paragraph (2) of the UUJN. The purpose of this study was to analyze the meaning of article 37 paragraph (1) and (2) UUJN to notaries who provide legal services for free, to find and to analyze constraints in the application of article 37 paragraph (1) and (2) UUJN in providing services the law in the notary field to a poor person by a notary in Brebes Regency. The method used was empirical juridical and took location in Brebes Regency. The samples in this study were notary in Brebes Regency.Keywords: legal services; free; notary.

This study aims to determine the position of the beneficiary 1. child out of wedlock in perspective Compilation of Islamic Law and the Civil Law (Burgerlijk Wetboek). 2. similarities and differences in the position of heir child out of wedlock in perspective Compilation of Islamic Law and the Civil Law (Burgerlijk Wetboek). The methods used include normative juridical approach with a qualitative descriptive study specifications. The method of data collection is literature study / documentary study of the primary legal materials, secondary law and tertiary legal materials by using qualitative analysis. The results of the study showed that notch that the child outside the mating according to KHI only have a relationship of inheritance with her birth mother, while according to Article 272 of the Civil Law can be seen that in the Civil Law there are children who do recognition and can be passed that Natuurlijk Kind, and there is also a child that can not be done against the overspeleg kind of recognition and blodsceneg. With the recognition that there arose a civil relationship between children and parents outside mating admit as stipulated in Article 280 of the Civil Law. Equal status illegitimate children in the perspective of the KHI and Civil Law is equally no right of inheritance. The difference is the inheritance rights of children outside of marriage can be granted if there is recognition of illegitimate children Natuurlijk just kind only. ABSTRAKPelaksanaan pembuatan Akta Pemberian Hak Tanggungan kepada Bank tidak telepas dari peran Notaris dan Pejabat Pembuat Akta Tanah (PPAT). Kegiatan antara bank dan debitur yang melakukan peralihan jaminan Hak Tanggungan tersebut sangat berkepentingan untuk membuat suatu perjanjian diantara mereka. Dari pandangan perbankan, akta Notaris merupakan alat bukti yang kuat dan menjadi perlindungan bagi bank dalam perjanjian kredit sebagai perjanjian pokok dari perjanjian jaminan Hak Tanggungan.Problematik penelitian ini adalah : Bagaimana Kerjasama Notaris-PPAT Terhadap Bank Di Dalam Pembuatan Akta Pemberian Hak Tanggungan? dan Apakah Kelemahan-kelemahan dan solusi kerjasama Notaris-PPAT Terhadap Bank dalam Pembuatan Akta Pemberian Hak Tanggungan?Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis-normatif yang bersumber dari pengumpulan data yang diperoleh dari data primer dan data sekunder, kemudian dianalisis dengan metode analisis kualitatif. Teknik pengumpulan data yang digunakan adalah studi kepustakaan (undang-undang, pendapat para ahli dan literatur-literatur buku mengenai tesis ini). Teknik analisis data menggunakan analisis data kualitatif.Hasil temuan peneliti menunjukkan bahwa Kerjasama notaris dalam sistem pemberian kredit yang dilakukan pihak perbankan adalah untuk memberi kepastian hukum bagi para pihak yang mengadakan perjanjian kredit. Adapun kelemahan kerjasama Notaris-PPAT terhadap Bank dalam pembuatan APHT sehingga menyebabkan perjanjian kredit tersebut diundur yaitu berpeluang karena terdapat kelalaian petugas bank, kepala seksi bagian kredit yang bersangkutan berhalangan serta jarak antara Kantor Notaris-PPAT rekanan dengan kantor bank terlampau jauh. Atas dasar kelemahan diatas maka solusinya adalah sebelum dilakukan pembuatan perjanjian kredit terlebih dahulu pihak-pihak yang bersangkutan dalam pembuatan perjanjian melakukan pengecekan bersama tentang kepastian sertifikat agar tidak terjadi ditemukannya sertifikat belum balik nama pada waktu akan merealisasikan perjanjian tersebut, selain itu para pihak yang berkepentingan harus benar-benar sepakat terhadap waktu yang sudah ditentukan bersama.Saran kepada pihak hak sebaiknya dalam mempersingkat waktu proses pembuatan perjanjian kredit hendaknya bank membuat kesepakatan janji terlabih dahulu untuk melakukan realisasi perjanjian kredit yang valid dengan kesemua pihak yang bersangkutan untuk diharapkan hadir tepat waktu.Kata Kunci : Notaris, PPAT dan Bank ABSTRACTThe implementation of the Deed of Granting of Deposit Rights to the Bank is not stemmed from the role of Notary and Land Deed Officials (PPAT). Activities between banks and borrowers who make the transfer of security guarantee of the Mortgage is very concerned to make an agreement between them. From a banking perspective, a Notary deed is a strong evidence and serves as a safeguard for the bank in the credit agreement as the principal agreement of the guarantee agreement on Mortgage Rights.The problematic of this research is: How to Cooperate Notary-PPAT Against Bank In Making Deed of Granting of Mortgage Right ? and What are the weaknesses and solutions of cooperation between Notary-PPAT Against Bank in Making Deed of Granting of Mortgage Right ?The method used in this research is with the juridical-normative approach derived from data collection obtained from the primary data and secondary data, then analyzed by qualitative analysis method. Data collection techniques used are literature studies (laws, expert opinions and book literature on this thesis). Data analysis techniques used qualitative data analysis.The findings of the research indicate that notary cooperation in the crediting system by the banks is to provide legal certainty for the parties to enter into credit agreement. The weakness of cooperation of Notary-PPAT to Bank in making APHT causing credit agreement is delayed that is because there are negligence of bank officer, head of credit section concerned and unable to distance between Notary Office-PPAT partner with bank office too far. On the basis of the above weakness then the solution is prior to making the credit agreement in advance the parties concerned in making the agreement to check together about the certainty of the certificate in order to avoid the discovery of the certificate has not returned the name at the time will realize the agreement, in addition to the parties concerned should totally agree on a specified time togetherAdvice to the right party should be in shorten the process of making the credit agreement should the bank make a pledge agreement reached to make the realization of a valid credit agreement with all parties concerned to be expected to attend on time.Keywords : Notary, PPAT and Bank

The purpose of this research are: 1) To analyzing role notary in the process of establishment of foreign investment limited liability company under the laws of a limited liability company in Kendari. 2) To analyzing obstacles is facing a notary in the process of establishment of the Foreign Investment Limited Liability Company under the laws of a limited liability company in Kendari and provide solutions to these obstacles. And secondary data obtained from the results of research studies that literature. Based on The role of the Notary In Process Incorporation Limited Liability Investment Asing based on Act of Company Limited in Kendari is providing legal advice and pouring the will of the parties to the deed of incorporation in order to not conflict with existing regulations and is responsible for ensuring the deed of incorporation approved by the Minister of Justice and Rights Human Rights of the Republic of Indonesia, and once approved, the deed of establishment is the highest law for limited liability companies and limited liability company and a binding third party. Barriers Faced Notary In Process Incorporation Limited Liability Based on the Foreign Investment Limited Liability Company Act in Kendari is: a) Business Licensing; b) domicile Enterprises; c) Determination Business Sector; d) Administrative requirements; e) Capital To Establish Company. The purpose of this study was to: 1) determine the procurement of land for public purposes on a motorway in Kendal. 2) Knowing the Notary PPAT role in proving the juridical data on compensation for land acquisition. 3) To analyze the challenges and solutions implementation of land acquisition for public use on the highway in Kendal. The method used is a socio-legal approach. Socio-legal is an approach taken by seeing something legal reality in society, and is an approach that is used to look at the legal aspects of social interaction in the community.Based on data analysis concluded that: 1) the implementation of land acquisition for public purposes toll on the motorway in Kendal includes 4 stages of land acquisition planning phase, preparation phase by forming a team preparation, the implementation phase of land acquisition, and the outcome of the submission phase. 2) The role of the Notary / PPAT of completing related legal compensation and transfer of land rights. 3) The obstacles that occur freely buying and selling land, the process of inheritance, their absentee land ownership, does not agree with the price offered. This research aims to: 1)To know and understand, that notaries who runs the office for public use, in addition to protection by the State, as well as the protection of Indonesian Notary Association and Honorary Council of Notaries; 2) Assess and analyze about a Notary that in using the rights and obligations dissenter contained in the Law on Notary, and legislation more specifically and expressly provides that the Notary concerned shall provide information, and in this case when the Notary the unlock the secrets of (the contents of) the deed; 3)To assess, and to know what are the weaknesses, as well as a solution to the problems in the implementation of legal protection in carrying secret notary office as a notary public.Type of this research is by using a normative juridical approach of the Act (statute approach), Conceptual approach. Legal materials used are the primary law materials, secondary law, and the tertiary law.Based of this study concluded that: 1) Under the provisions of Act No. 2 of 2014, amendments to the Act No. 30 of 2004 Article 4 and Article 16 paragraph (1) letter f, that Notaries have the authority and obligation to keep professional secrecy regarding the Deed and any information obtained in the manufacture of deed and conceal the contents of the deed and he knew a good description of the past, present and future; 2) that the Notary is obliged and has a right of refusal on the confidentiality deed that has been made and all information obtained for a deed in accordance with the oath / pledge of office, unless the law determines the other; and 3) Based on the description of the foregoing in the implementation of the legal protection of notary there are still weaknesses in terms of both implementation and legal certainty. The purpose of this study is as follows: 1) To determine the role of the Notary PPAT in the process of the transfer function of soil from agricultural to non-agricultural land in the District Land Office Demak.2) To know the obstacles in the process of soil functions from agriculture to non-agricultural land in the Land Office District Demak.3) .To find out a solution to the obstacles in the process of the transfer function of soil from agricultural to non-agricultural land in Demak District land Office.Methods using sociological juridical approach, Research Specs, Types and Sources of Data, Data Collection Methods, Technical Analysis.Based on the results of the study concluded that the procedure of land transfer function of agriculture to non-agricultural land in the National Land Office Demak, do the applicant by way of location permits, licenses and land use permits land use changes. Factors to be an obstacle in the procedure of the transfer function of the land from agricultural land to non-agricultural in the Office of the National Land Demak and how to overcome among others: the permissions that are not in accordance with the plan of spatial Demak, settlement efforts in addressing licensing should be transparent and in accordance with the regional spatial plan Demak. The purpose of this study were 1) to identify and explain the authority of a judge to cancel the notarial deed as authentic evidence 2) To identify and explain the condition of the cancellation of a notary and legal consequences of the cancellation of an authentic deed. This research method is using empirical juridical approach "empirical juridical approach used to study the legislation. Specifications research used in this study is a descriptive analysis, from this study is expected to obtain a detailed and systematic description of the problem to be studied. Based on data analysis concluded that 1) Judges have authority give an assessment of a notarial deed which was used including eventually issued a verdict "cancel" the notarial deed. The authority of judges in dismissing a notarial deed in a civil case is based on the plaintiff's request wants in the lawsuit. The judge is not authorized to hear and determine a claim outside of what is included or requested by the parties in the suit so the judges to be passive. 2) The cancellation of the notary deed because of the element of achievement or objective requirements of the power of attorney and the deed of sale. As a result of the law is a) Clear and void as a result, legal acts which do not have legal effect from the occurrence of such legal acts. b) Can be canceled: legal act performed does not have the legal effect since the cancellation. c) Degraded strength of proof (UUJN): an authentic act has the strength of evidence that is complete or perfect in the proceedings, but the forces can be degraded / slowdown / downturn into a deed under the hand when in the making violation of the provisions of the requirements under laws apply. d) Subject to administrative sanctions in the form of verbal warning and a written warning light if violations.Keywords: Authority; Deeds; Notary; Authentic evidence
