Abstract

Birth of the Law of the Republic of Indonesia Number 5 of 1960 on Basic Regulation of Agrarian (BAL) has brought about significant changes in the world Indonesian land. BAL and a set of implementation regulations are expected to provide legal guarantees for the rights holders on the ground. But in fact the land can not be separated from problems, one of which occurred in Cirebon is the emergence of multiple certificate which led to the dispute. Here will be explained the factors that led to the emergence of a double and a certificate of completion method of dispute. To the authors do research with sociological juridical approach that combines literary and legal material facts obtained in the field through interviews. From these studies obtained answers that the emergence of double certificates can occur due to external factors and internal factors. For that matter, BPN trying to find a way out with the mediation. But if it does not receive the meeting point, the parties can file a lawsuit in court.Keywords: Dispute; Double certificates.

Abstract

Practice transitional land rights usually involve communities affected by development projects such as those in Pemalang-Batang toll road construction project. The method used in this research is juridical empirical method. This research is descriptive. With the research that is descriptive, it can be analyzed and compiled the data collected, so that it can be concluded that a general nature, as well as giving a clear picture of the role of the Notary in the transaction of land acquisition for the construction site of Pemalang-Batang Toll Road (PBTR) , The field data were analyzed qualitatively and literature that only retrieve data related to the issues discussed. Legal uncertainty for public land needs to be a concern for the government. As for efforts to be made, among others, regulatory arrangement to produce quality legal regulations, Based on Presidential Decree Number 36 Of 2005 and Presidential Decree No. 65 of 2006, there are two points that are important in the release of land property rights to state land. The process of transitional status of land property rights to state land to development projects Pemalang-Batang toll road has reached 99.21% starting in October 2017. This indicates that the transition process is almost completed and the soil needs to be studied further whether the operation has been fulfilling the principle of justice, Based on Presidential Decree Number 36 Of 2005 and Presidential Decree No. 65 of 2006, there are two points that are important in the release of land property rights to state land. Abstract

ABSTRAKKetentuan Pasal 4 dan Pasal 16 ayat (1) huruf f Undang-Undang Jabatan Notaris mewajibkan notaris untuk menjaga kerahasiaan segala sesuatu mengenai akta yang dibuatnya dan segala keterangan yang diperoleh guna pembuatan akta sesuai dengan sumpah janji jabatan kecuali undang-undang menentukan lain. Kemungkinan terhadap pelanggaran kewajiban tersebut berdasarkan Pasal 16 ayat (11) Undang-Undang Jabatan Notaris, seorang notaris dapat dikenai sanksi berupa teguran lisan sampai dengan pemberhentian dengan tidak hormat. Terlebih lagi dengan adanya putusan Mahkamah Konstitusi Republik Indonesia dengan Nomor: 49/PUU–X/2012 memutuskan telah meniadakan atau mengakhiri kewenangan Majelis Pengawas Daerah (MPD) yang tercantum dalam Pasal 66 ayat (1) UUJN membuat notaris seakan-akan tidak ada perlindungan hukum bagi notaris dalam menjalankan tugas jabatannya. Ikatan Notaris Indonesia (INI) harus berusaha menjalankan peranan pembinaan dan perlindungan meningkatkan pengetahuan, kemampuan dan keterampilan para notaris. Demikian juga menjalin hubungan dengan para penegak hukum lainnya, agar penegak hukum lainnya yang ada hubungan dengan notaris dapat memahami kedudukan notaris sesuai UUJN.Berangkat dari pemikiran inilah kewajiban ingkar notaris masih tetap dipertahankan oleh pembuat undang-undang dalam revisi Undang-Undang Jabatan Notaris Tahun 2014 yang merupakan konfigurasi kekuatan perlindungan terhadap profesi dan jabatan notaris dari sisi politik.Kata Kunci : Jabatan Notaris, Hak Ingkar, Perlindungan Hukum.ABSTRACTThe provisions of Article 4 and Article 16 paragraph (1) sub-paragraph f of the Notary's Office Law require a notary to maintain the confidentiality of all matters concerning the deeds it has made and all the information obtained for the deed in accordance with the oath of pledge of office except the law otherwise. The possibility of breach of such obligation under Article 16 paragraph (11) of Notary Law Regulation, a notary public may be subject to sanctions in the form of oral reprimands until dismissal with disrespect. Moreover, with the decision of the Constitutional Court of the Republic of Indonesia with the number : 49 /PUU-X/2012 deciding to have canceled or terminated the authority of the Regional Supervisory Board (MPD) listed in Article 66 paragraph (1) UUJN made a notary as if there was no legal protection for a notary in performing duties. The Indonesian Notary Bond (INI) should endeavor to undertake the role of guidance and protection to increase the knowledge, abilities and skills of the notaries. Likewise establish relationships with other law enforcers, so that other law enforcement who has relationship with the notary can understand the position of notary under the UUJN.Departing from this thought the obligation of notarization is still maintained by the lawmakers in the revision of the Law Regulation of Position Notary on Year 2014 which is the configuration of the strength of the protection of the profession and the notary's position from the political side.Keyword : Position of Notary, Right of Remedy, Legal Protection.

Abstract

Penelitian dengan judul ” Akibat Hukum Verifikasi Dan Validasi Bea Perolehan Hak Atas Tanah Dan Bangunan Oleh Dinas Pengelolaan Pendapatan Keuangan Dan Aset Daerah Terhadap Akta PPAT di Kabupaten Tegal” dengan menggunakan pendekatan metode yuridis empiris, dalam pengumpulan  data yang ada dilapangan dengan wawancara kepada para pihak yang terkait dengan masalah yang di teliti kemudian dikaji dengan sumber hukum berupa peraturan perundang-undangan, kaidah-kaidah hukum maupun teori ilmu hukum.Penelitian  ini menghasilkan pada pokoknya  :  Pelaksanaan verifikasi dan validasi Bea Perolehan Hak Atas Tanah Dan Bangunan oleh Dinas Pengelolaan Pendapatan Keuangan Dan Aset Daerah Terhadap Akta PPAT Di Kabupaten Tegal di atur dalam Peraturan Bupati Tegal Nomor 32 tahun 2012 Tentang Tentang Bea Perolehan Hak Atas Tanah Dan Bangunan yaitu pasal 31 sampai dengan pasal 35.  Dalam penentuan besaran BPHTB mendasarkan pada nilai terbesar antara nilai jual beli sebagaimana akta jual beli dan nilai NJOP dan nilai transaksi/nilai pasar yang telah di tentukan oleh Dinas Pengelolaan Pendapatan Keuangan Dan Aset Daerah. Akibat hukum dari Sistem verifikasi dan validasi pembayaran BPHTB yang diatur di dalam Peraturan Bupati Nomor 32 tahun 2012 sudah menghilangkan prinsip sistem Self Assessment karena Wajib Pajak tidak dapat lagi menghitung dan membayarkan sendiri utang pajaknya. Sehingga Peraturan Peraturan Bupati Nomor 32 tahun 2012 Tentang Tentang Bea Perolehan Hak Atas Tanah Dan Bangunan tersebut tidak sesuai dengan aturan yang terdapat dalam Peraturan Pemerintah Nomor 91 Tahun 2010 tentang Jenis Pajak Darah yang dipungut berdasarkan penetapan kepala daerah atau dibayar sendiri oleh wajib pajak, sehingga dapat dibatalkan demi hukum. Akta PPAT selama memenuhi syarat sahnya perjanjian sebagaimana dalam Pasal 1320 KUHPerdata, serta di buat oleh pejabat yang berwenang dengan berdasarkan undang-undang sebagaimana Pasal 1868 KUH Perdata mempunyai kekuatan hukum mengikat sebagaimana kekuatan hukum akta ontentik, meskipun tidak bisa dilaksanakan ketika dalam Verifikasi Dan Validasi Bea Perolehan Hak Atas Tanah Dan Bangunan oleh Dinas Pengelolaan Pendapatan Keuangan Dan Aset Daerah. Kata kunci : Akibat Hukum, Verifikasi Dan Validasi, Bea Perolehan Hak Atas Tanah Dan Bangunan

Abstract

Registration of land as a form of implementation of the government's obligation to guarantee legal certainty and the protection of land ownership. The purpose of this research are: 1) To analyze the Complete implementation of Systematic Land Registration in Grobogan. 2) To analyze barriers that occur in the Implementation of Complete Systematic Land Registration in Grobogan. 3) Analyze solutions to the obstacles to the full implementation of Systematic Land Registration in Grobogan. This study using sociological juridical approach namely a study conducted in depth against the reality-a reality that exist within the community and surrounding environment for the purpose of finding facts there and then will discuss the problems that exist.Based on the results of data analysis concluded that that There are several stages in the implementation of location determination PTSL among other things, education, the establishment of the adjudication committee, the announcement of physical data and juridical. In the implementation of PTSL there are several barriers among others are plots of land still in dispute, plots the subject is still not clear, less pro-active society and other but officials PTSL seeks to overcome these obstacles with solutions that are effective in order stand on PTSL program is going well and smoothly in the interests of the general public.Keywords: Complete Systematic Land Registration; Without PPAT Deed.

Abstract

Supervisory Council is an entity that has the authority to implement the guidance and supervision of a Notary. Regional Supervisory Council (MPD) is formed in the District / City to develop and supervise the notaries who have work areas Regency / City, in accordance with Article 70 UUJN.The purpose of this study was to analyze the effectiveness of the supervision of the Regional Supervisory Council and the barriers and surveillance solutions Regional Supervisory Council in an effort to increase the professionalism of a notary in Purwokerto and Purbalingga region. This study uses empirical juridical approach, whereas the method of data collection with the literature study and interviews.Results of research supervision by the MPD in Purwokerto and Purbalingga is still not effective, and can not improve the professionalism of a notary in the region of, because they found many violations of the code of conduct. Obstacles encountered MPD is a shortage of funds, lack of secretarial offices and infrastructure that support the implementation by both the duty and authority MPD limited authority and lack of legal awareness of some of the Notary. Some of the possible solutions is to build its own secretary building with the infrastructure that support the implementation of the duties and authority both MPD and monitoring internal, external, repressive and preventive.Keywords: MPD; Supervision Notary Code of Ethics Violations

Abstract

ABSTRAKKekuatan Hukum Sertifikat Hak Tanggungan dalam hal musnahnya objek Hak Tanggungan karena bencana alam di Kabupaten Grobogan menjadi menarik untuk dibahas penulis, karena menimbulkan dampak bagi pihak kreditur. Dimana kreditur kehilangan objek atau benda jaminan yang sedang dibebani hak tanggungan. Dalam hal ini debitur tidak dapat disalahkan karena musnahnya objek atau benda yang dibebani hak tanggungan musnah oleh bencana alam, karena kapan terjadi dan dimana terjadinya bencana tidak dapat diduga dan diluar kekuasaan para pihak, hal ini merupakan keadaan memaksa atau overmacht/ forje majeur. Sehingga penulis merumuskan beberapa permasalahan, yang pertama adalah bagaimana kekuatan hukum sertifikat hak tanggungan dalam hal musnahnya objek hak tanggungan karena bencana alam, lalu permasalahan yang kedua adalah bagaimana perlindungan hukum terhadap pemegang sertifikat hak tanggungan yang musnah karena bencana alam.Pada penulisan tesis ini, penulis menggunakan metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis sosiologis (socio legal research) yang berarti mengidentifikasi suatu persoalan hukum dari sudut pandang sosial. Untuk menjawab permasalahan seputar hukum perdata terkait tentang Hak Tanggungan. Hasil penelitian yang dilakukan oleh penulis, pertama didapatkan bahwa kekuatan sertifikat hak tanggungan hapus apabila objek hak tanggungan telah musnah oleh bencana alam walaupun hal ini merupakan keadaan yang tidak disengaja dan di luar kekuasaan para pihak. Permasalahan kedua bahwa perlindungan hukum terhadap pemegang hak tanggungan, di dapatkan melalui prosedur pemberian kredit oleh pihak kreditur/ pemegang hak tanggungan, dengan melaksanakan prinsip kehati-hatian sehingga pihak kreditur dapat memperkecil resiko debitur cidera janji/ lalai/ wanprestasi. Adanya formulir syarat umum yang diberi stempel Notaris atau PPAT dibaca dan apabila disetujui oleh debitur, tanda tangan diatas materai. Kemudian, adanya prosedur penerbitan akta hak tanggungan baik itu SKMHT maupun APHT hingga pendaftaran sertifikat hak tanggungan di BPN hal ini untuk mendapatkan kekuatan hukum secara otentik dan mutlak sehingga apabila terjadi sesuatu dapat ditangani berdasarkan dasar hukum dan ketentuan yang telah disetujui oleh para pihak.Kata kunci :Sertifikat Hak Tanggungan, Objek Hak Tanggungan, Bencana Alam ABSTRACTThe Legal Strength of the Certificate of Mortgage Right in the event of the disappearance of the object of Mortality Right due to natural disaster in Grobogan district becomes interesting to be discussed by the author, because it has an impact for the creditor. Where a creditor loses an object or collateral item that is being burdened with a mortgage. in this case the debtor can’tbe blamed for the disappearance of objects or objects burdened by the mortgage is destroyed by natural disasters, because when and where the occurrence of disasters can’t be expected and beyond the power of the parties, this is a state of coercion or overmacht / forjemajeur. So the authors formulate some problems, the first is how the legal power of dependent certificates in the event of loss of mortgage objects due to natural disasters, then the second problem is how the legal protection of the dependent certificate holder who destroyed by natural disasters.In writing this thesis, the author uses the approach method used in this study is sociological juridical method (socio legal research) which means identifying a legal issue from a social point of view. which is a scientific research that has a function to answer the problems surrounding civil law. In the results, the first problem can be concluded that the strength of the mortgage certificate is deleted if the object of mortgage rights has been destroyed by natural disasters even though this is an unintentional situation and outside the power of the parties. In second case, it can be concluded that the legal protection of the mortgage holders is obtained through credit lending procedure by the creditor / holder of mortgage, by implementing the prudential principle so that the creditor can minimize the risk of the default / negligent debtor. The existence of a general terms form to be readed, and stamped by Notary or PPAT and signature by the debtor. Abstract

Perumusan masalah dalam penelitian ini adalah bagaimana  perbedaan perjanjian kredit di bank konvensional dengan akad pembiayaan di bank syariah, bagaimana  peran Notaris dalam pelaksanaan pembuatan akta akad pembiayaan di Bank Syariah, bagaimana akibat hukum yang timbul terhadap akta akad pembiayaan di Bank Syariah menurut Undang-undang Nomor 2 Tahun 2014 tentang Jabatan NotarisHasil penelitian ini menyimpulkan notaris dalam pelaksanaan pembuatan akta akad pembiayaan di Bank Syariah bahwa peran  notaris di dalam pembuatan akta akad pembiayaan di bank syariah sepanjang yang menyangkut akta yang dibuatnya, Notaris berperan sepanjang mengenai orang, untuk kepentingan siapa  akta itu dibuat, Notaris berperan  sepanjang mengenai tempat, di mana akta itu dibuat  dan Notaris berperan sepanjang tempat kedudukan pembuatan akta itu. Akibat hukum yang timbul terhadap akta akad pembiayaan di Bank Syariah adalah bahwa pihak yang berwenang membuat akta otentik adalah notaris,  terkecuali wewenang tersebut diserahkan pada pejabat lain atau orang lain, kemudian dari sisi Grosse Akta Pengakuan Hutang  akan mempunyai kekuatan  eksekutorial dan di samakan dengan keputusan hakim. Akibat yang lain adalah ketergantungan bank terhadap Notaris hingga notaris harus  dianggap sebagai mitra atau rekanan dalam pelaksanaan suatu  akta akad pembiayaan. Kata Kunci: Perjanjian Akad Pembiayaan Syariah Notaris

Abstract

This study aims to determine the readiness of governments to regulate and promote the performance of the notary through UUJN and implementation supervision performed by the Supervisory Council, how effective arrangements and Notary Code UUJN to the quality of performance of a notary. The writing method is based on the normative juridical research with a normative approach carried out by analyzing the material by reference to the norms of law - legal norms in the implementation of the code of conduct notary. The results of this study that the notary in carrying out its duties and responsibilities can not be separated from the code of conduct that has been set. But not infrequently the notary work outside their code of ethics. Actions that violate the code of conduct notary, such as signing a deed that is not done in the presence of a notary, a deed outside the office and a deed which is not in accordance with the provisions contained in Law No. 2 of 2014. This of course led to the violation of the law regarding the conduct of their duties. So supervision by the Indonesian Notary Association (INI) has an important role towards the creation of a notary who work according to the code of conduct. Monitoring carried out INI is more enforcement against notary abuse, such as giving reprimand, warning and suspension or even expulsion from membership. Abstract

The purpose of this research is 1) To know the process of registration of transfer of land rights that have not been certified for sale and purchase and registration rights. 2) To determine the legal problems of transitional registration of land rights that have not been certified for sale and purchase and registration rights. 3) To know how the efforts and steps that should be done by the Land Office to resolve the legal problems of transitional registration of land rights that have not been certified for sale and purchase and registration rights.The method used is empirical juridical approach in order to obtain adequate results. Specifications research used in this study is a descriptive analysis, from this study is expected to obtain a detailed and systematic description of the problem to be studiedBased on data analysis concluded that: 1) The preparation of the deed of sale of land rights, advance PPAT shall conduct an inspection at the office of district / city land on the validity of the certificate of land rights are concerned. Second, the implementation PPAT deed to be attended by the parties concerned to take legal actions (seller and buyer) or a person authorized by him with written authorization in accordance with applicable laws and regulations.
