Abstract

Among Muslims, there are assumptions or thoughts that equalize instantly between Shari’ah and fiqh, namely both of them are identified as Islamic law. In here, there seems to be no clarity of position and territory between Islamic law ( fiqh), which practically is identic with the results of ijtihad, with syari’ah which in its concrete meaning is identical with revelation. Therefore, the translation of syari’ah with Islamic law can actually be seen as a mistake, even though it has been widely used (including what the author uses in this paper). The term Islamic law may be more accurately equated with fiqh, namely the syari’ah which has been interpreted. and need to be poured into a law first (to be a positive law) so it becomes realistic and applicable. But to put it into a law, in order not to be counterproductive and can truly realize the benefit of individual and social life, the syari’ah cannot be applied at glance without a clear formula, perfect planning, precise calculations, and considerations wise, and not merely legalistic and formalistic nuances. Keywords: Syari’ah, Politic Identity, Islamic World, Contemporary Di kalangan umat Islam, terdapat anggapan atau pemikiran yang menyamakan begitu saja antara syari’ah dan fiqh, yakni keduanya sama-sama diidentifikasi sebagai hukum Islam. Di sini tampak tidak adanya kejelasan posisi dan wilayah antara hukum Islam ( fiqh), yang pada prakteknya identik dengan hasil ijtihad, dengan syari’at yang dalam arti kongkritnya identik dengan wahyu. Karena itu, penerjemahan syari’ah dengan hukum Islam sebenarnya dapat dipandang sebagai sebuah kekeliruan, walaupun telah digunakan secara luas (termasuk yang penulis gunakan dalam makalah ini). Istilah hukum Islam barangkali lebih tepat disamakan denga fiqih, yakni syariat yang telah ditafsirkan. dan perlu dituangkan terlebih dahulu ke dalam sebuah undang-undang (menjadi hukum positif) sehingga menjadi realistik dan aplikatif. Namun untuk menuangkannya ke dalam sebuah undang-undang, agar tidak kontraproduktif dan benarbenar dapat mewujudkan kemaslahatan bagi kehidupan individu maupun sosial, syari’ah tidak bisa diterapkan begitu saja tanpa formula yang jelas, perencanaan yang matang, perhitungan yang tepat, dan pertimbangan yang bijaksana, serta tidak bernuansa legalistik dan formalistik belaka.
